In Ireland, it may soon be expressly illegal to have sex with someone who has passed out drunk. The country’s Justice Minister, Frances Fitzgerald, has introduced a new law, which could rewrite the definition of consent and will also include protections for people with disabilities who may not be able to communicate verbally. The new law would make it clear that a person who is intoxicated to the point of being unconscious cannot give consent. The current Irish definition of rape is pretty vague, stating that rape occurs when a person has not consented, or if the perpetrator is “reckless to whether or not he or she has consented.” This vague definition has made some cases complicated and required interpretation by the court. The new bill will also make buying sexual services illegal, and tighten the laws regarding child pornography.
