Last Friday night two Texas high school football players pummeled a referee while on the field during a game. The two students claim that this referee was directing racial slurs toward them and making bad calls.

To make things worse, the assistant head coach, Mack Breed, allegedly told the players that this ref needed “to pay for cheating us,” or words similar to that sentiment. So, instead of keeping his cool and being a responsible adult, it seems that this man essentially instructed his players to go out there and do something about what they felt were unfair or bad calls. Instead of following the simplest guidelines and informing the lead official of the game, Mack Breed allegedly thought that it be wise to have the kids take it into their own hands. Instead of being an adult and taking this moment to turn into something teachable he did the exact opposite.

According to the Northside Independent School District, the district that John Jay High School falls under, the two players have been suspended from school and will have to attend a disciplinary hearing which will treat the incident as “an assault on a school official.” Naturally there is also a complaint being filed with the Texas Association of Sports Officials against the referee for the racial slur allegations.

Fellow Law Streeter, Alexis Evans, caught this story early on and had great insight about whether or not the players will be hit with criminally charges. I would add that in the state of Texas simple assault consists of; (a) intentionally, knowingly, or recklessly causing bodily injury to another person, (b) intentionally or knowingly threatening another person with imminent bodily injury, or (c) intentionally or knowingly causing physical contact with another that the offender knows or reasonably should know the victim will find provocative or offensive. That is what these players committed, unless there has been serious bodily harm done to the referee which there has been no report of as of today.

If there is serious bodily harm done then these players could be charged with aggravated assault which consists of; (a) intentionally, knowingly or recklessly causing serious bodily injury to another person, or (b) using or exhibiting a deadly weapon in the course of committing any assault crime, including threatening another with bodily injury or engaging in conduct that the victim likely will find offensive. For the sake of an argument, it is very possible that a football helmet could be seen as a deadly weapon and these boys could be charged with aggravated assault if there was more bodily injury done to the ref than what we know about. With as hard as his head snapped back upon the first impact, who knows what kind of internal damage was done. I strongly believe that these players should be charged with some kind of criminal offense–it’s too obvious that they were harming this man intentionally.

But I have to ask, don’t these kids know better? If the ref was making racial slurs then that needed to be dealt with through the lead official at the game, the school district, and the Texas Association of Sports Officials. Didn’t the assistant coach, Mack Breed, know that fact? Shouldn’t he have known that kids are easily encouraged and saying something like “he needs to pay” is an insinuation that these kids should do bodily harm to the ref? I posed this question to my Sports Law professor, Samuel Renaut, and his response was a bit mind blowing but also very true. He stated that in his experience in the sports industry “you can never assume people will know better. They often don’t.” Which is a very sad truth.
There is a certain level of expectation that a ref could be harmed indirectly if he gets caught during a play but when a man is standing, facing the opposite direction, watching the actual game (doing his job) and these kids come up behind him and intentionally do bodily harm he is not liable. He had no way of knowing what was coming and was not able to take action to protect himself. If anything the coaching staff of the team is to blame, and those young men should be prosecuted. A lesson needs to be learned. There is a proper way of doing things that does not require hurting anyone. They may have even harmed themselves because the choice they made to harm that ref will be carried with them the rest of their lives and could very well ruin any career they could possibly have playing sports.
Now we just have to wait to see what the school district, the police, and TASO decide to do about the incident as a whole.

It’s been a while but let’s jump right into what is going on in the news this week.

The Italian Court of Cassation (the top criminal court in Italy) has officially thrown out the guilty verdicts of Amanda Knox and her ex-boyfriend  Raffaele Sollecito, an Italian native.

On November 2, 2007 the body of 21-year-old UK citizen, Meredith Kercher, was found in the home that she shared with Amanda Knox in the college town of Perugia, Italy. Amanda Knox, her then-boyfriend Raffaele Sollecito, and Rudy Guede (from the Ivory Coast) were all prime suspects and were eventually tried and convicted of Kercher’s murder.

In the first trial in 2009, Amanda Knox was convicted of murder, sexual assault, and slander with an original sentence of 26 years in prison. Raffaele Sollecito was convicted of murder and sentenced to 25 years in prison. Rudy Guede was later tried and convicted of murder with a 16 year sentence; he admitted to being inside the home when Kercher was murdered and his DNA was found all over her bedroom where her body was found.

In 2011, Knox and Sollecito appealed and the court throw out the original convictions, except for Knox’s slander charge which required only a year of prison time that was counted as served in the four years that Knox had already spent there. But in 2013, the high court in Italy reversed the acquittal and required another appeals trial. Then in 2014 the new appeals trial held the original 2009 conviction and ordered Amanda Knox to serve 28 1/2 years in prison (including the one year for slander) but kept Sollecito’s time to 25 years.

But finally, in March of this year the Italian high court found that Knox and Sollecito did not murder Kercher, and just a couple of days ago the court released its final statement and reasoning behind this decision.

The Court of Cassation wrote that there was an “absolute lack of biological traces” of Knox and Sollecito in Kercher’s bedroom or even on her body. The Court also noted that there was a plethora of omissions and poorly executed investigations into this case.

Case in point, the original prosecutor Giuliano Mignini was one piece of work. While he was prosecuting Amanda Knox, he was making his own court appearances for indictments starting in 2006 for “abuse of office power” and “abetting” in connection to another high profile case. So, essentially the prosecutor seemingly liked getting his way by any means necessary and encouraging others to break the law too.

Now, I have been following along with this case for quite sometime and I have a hard time distinguishing the truth. Sometimes I believe that Knox was not involved but then other times I have to wonder if she really was. Some of Knox’s actions are consistent of a scared 20-something living in a foreign country but then there are other things that scream she knew at least that something was going on. We may never know the truth, but this latest ruling by the court should put an end to the saga of Amanda Knox’s fate, and let the family of Meredith Kercher move on with their lives.

Last week lawmakers in Utah passed HB 249, which “allows a person conceived through assisted reproduction access to non-identifying medical history of the donor from the fertility clinic.” This is a huge deal that has gotten zero attention. Maybe a couple of articles in some random news sites; the Salt lake Tribune and USA Today have covered it, but nothing that has grabbed the country’s attention.

I know who both of my biological parents are (they did it the old fashion way), but my dad was adopted and there have been so many questions about his biological parents’ medical history. When filling out any medical forms there are always plenty of questions about my parents’ and grandparents’ medical histories that I sometimes just can’t answer because there isn’t much known on my dad’s side. There is a certain kind of frustration behind that because I could be facing health risks that are passed on genetically without knowing anything about it.

I’m a strong believer that having too much information is better than not having any information at all, especially when it comes to your health!

Utah’s new law gives people a better idea of what they are genetically predisposed to while still maintaining a certain level of anonymity for the donor.

USA Today discusses the lack of interest that legislators have in “assisted reproduction,” claiming that legislators are afraid to get their hands dirty because of the doors that could be opened into a deeper conversation about conception, abortion, and embryos. I know, I know, no one wants to have a continuous debate about those topics because it seems like each side is beating a dead horse, but there is something to be said about the fact that there are children out there who have no idea about one side of their genetic traits.

Currently countries like Canada, the United Kingdom, Germany, and Australia all heavily regulate many areas of reproductive technology, and many scholars around the world claim that the U.S. does not. Like somehow we have allowed this medical venture to fall by the wayside.

In my opinion the government does not need to have its hands in every single cookie jar unless it is completely necessary. There are already enough regulations set by the American Society of Reproductive Medicine, the American Medical Association, and the boards that license every doctor. It isn’t harmful for Utah’s legislature to step in and give people a legal right to know about their medical history. It’s impossible to get any information out of a doctor about someone else’s medical history and this just allows people to know what could possibly be in their future or what could affect their own children.

This legislation does open the door to other issues; donor-conceived offspring could want to have full access to all of the information about their donor. Sometimes people just want to know where they really came from, and sometimes the donor wants to know their offspring.

Sperm banks should do a full work up and have a detailed medical history about the person donating their eggs or sperm. I get that the process is meant to be quick and helpful for those who can not conceive without a little medical intervention, but in all reality it isn’t just sperm and eggs. These pieces of biology become human beings. This is the major process of creating a life. If you are going to create a life you should know all there is to know about the counterpart helping to create it!

Hey y’all!

I’m a big music fan–especially good music. In my opinion though, “Blurred Lines” by Pharrell Williams and Robin Thicke does not fall into that category. Sure the tune is catchy but listen to the words. Really listen to them, and of course watch the music video. I’m sure it was a just a fun thing for these guys to do one night but I bet they are regretting it now.


A jury in California found that the song was a rip off from Marvin Gaye’s “Got To Give It Up” — a song I know and love. The jury awarded Marvin Gaye’s family $7.4 million. That’s a lot of dough for one song!

I know both songs pretty well; one because its fun to listen to and the other because radio stations don’t know how to take a song off of repeat when it is released. I’m no music expert, just an enthusiast, but I have to wonder what is considered plagiarism and what is considered influence when creating music.

Pharrell claims that he grew up listening to Marvin Gaye so I am sure “Got to Give it Up” was included. It was probably one of those songs he listened to all the time and perhaps that catchy tune stayed with him and he wanted to express his love for it through the creation of his own with a little bit of a similar beat.

According to an expert supplied by Gaye’s family, there are “eight distinct elements” from ‘Got to Give It Up’ used in ‘Blurred Lines’. Eight elements. Is that like eight notes used consecutively that made it sound like it was ripped right from Gaye’s song? Or was it eight different pieces of ‘Blurred Lines’ that could possibly be the same as Gaye’s song because they are presented in the same manner or located at about the same point in the songs? I don’t get it.

I also have a tiny issue with the fact that jurors were subjected to hearing the entirety of ‘Blurred Lines’ on several occasions but none of those jurors got to hear Gaye’s song. It was taken apart and only played based off of sheet music. If that were the case then why didn’t they pick apart ‘Blurred Lines’ and present it to the jury solely based off of the sheet music? Again, I am not a fan of ‘Blurred Lines’ but I feel like this should have been a fair fight and it wasn’t.

I do feel bad for Pharrell because he is the one who signed a document stating he was the sole responsible party for any copyright claims. Kiss $7.4 million goodbye, Pharrell. But then again that just might be chump change to  him these days. On another note, Thicke had to fess up to not having a single thing to do with writing the song, so he looked like a fool.

Seems to me like “Blurred Lines” would have been best left on a shelf in some producer’s office instead of forcing its awfulness on to the masses and then creating all of this pain and anguish for Gaye’s family, Pharrell, and Thicke.

Hey y’all!

Yet again I have to question what is wrong with the female teachers in this country. Back in January, two teachers were arrested for allegedly having a beach sex party with five male students in California. Yesterday these two sick, sad teachers were hit with new charges. Melody Lippert, 38, and Michelle Ghirelli, 30, are both charged with a felony count of unlawful sexual intercourse and a felony count of giving a controlled substance to a minor. Ghirelli has also been charged with a felony count of oral copulation of a minor.

According to Ghirelli’s attorney, Stephen DeSales:

We intend to plead not guilty and intend to vigorously defend this case. What you will get from the district attorney is what they think they can prove. There’s two sides to every story.

I’m sorry, how is there a second side to this story that would make sense? These two women had sex with young boys at a beach and supplied the booze and drugs to go along with it.

I’m a few months shy of 30 and the idea of sex with a teenager is just repulsive, not to mention wrong. How do teachers and administrators at schools expect parents to feel comfortable sending their kids there when there is the possibility that their child is being preyed upon by the very people who are supposed to be protecting and teaching them?

I hope these women are convicted swiftly and thrown in jail. Registered sex offenders immediately!

I’m so disgusted by the number of female school teachers who have been arrested and convicted of sexual encounters of some kind with their students. It is unreal. I used to always suspect male teachers more than anyone, wrong I know but true. Nowadays you can’t go a month without hearing about some female teacher having some kind of sexual encounter with a student. Something is fundamentally wrong with these women and clearly the punishment is not strict enough to deter any of them from doing what they are doing. Perhaps the laws need to be revisited and a harsher punishment should be considered. These women are predators. These women are pedophiles. Desperate, pathetic disgusting pedophiles.

Hey y’all!

One hundred fifty-four years ago this week, citizens across the great state of Texas voted by a wide margin to secede from the United States. This vote finalized the state’s intentions of joining the Confederacy in the Civil War. Of course, the state declared the Ordinance of Secession null and void five years later in 1866. But those five years are something that most proud Texans hold on to for dear life. There are even some people in the state who actually think it is something we should do again.

The group Republic of Texas held a Valentine’s Day meeting  that was raided by several different law enforcement agencies, including the FBI, the Brazos and Kerr County Sheriffs’ departments, the Texas District Attorney’s office, the Bryan Police Department, and my personal favorite, the Texas Rangers (the law enforcement group, not the baseball team). The meeting was held in Bryan, Texas, about 100 miles northwest of Houston.

I can just imagine Chuck Norris kicking down the doors of a meeting hall where this event took place and these guys getting a what’s what kind of talking to.

 

Apparently the Republic of Texas group actually believes that Texas was unlawfully annexed in 1845 and should be recognized again as an independent nation. Sure, maybe this seems like a normal day in Texas–Texans sitting around talking about “the good ol’ days” (when none of us was actually alive) and how Texas would do so much better as a country of its own than attached to the whole of the United States. It’s just nuts to think that there are people who are actively seeking legal ways to make this happen.

You must be wondering why this silly group of people was raided on the most romantic holiday of the year. Well, instead of tending to their sweethearts, the group decided it was the right time to “simulate legal process.” They sent a legal summons to a Kerr County judge and banker to appear before the group’s “court” over the foreclosure of a residence belonging to a member of the group.

Wait. What!?! What exactly does a foreclosure have to do with seceding from the union, or anything with the state of Texas? Absolutely nothing.

Kerr County Sheriff Rusty Hierholzer told the Houston Chronicle that this group has had many dealings with the County and City police, “flooding the court with simulated documents.” Also known as wasting the government’s time and killing trees for a lost cause.

Though I was born in Germany I am definitely a fifth-generation Houstonian and I take serious pride in all things Texas, but even I have a hard time truly believing that seceding from the union would be a good idea. Sure, Texas is the greatest state in the country, but I don’t think it would be as great without the rest of the states and the federal government.

Let’s keep talking and dreaming about seceding, but let’s not actually do it. That would just be foolish. Plus, we usually have a Texan in the White House every couple of Presidents, anyway.

I’m a Texas girl and you know we love our death penalty down here, but this week it was interesting to discover that Utah is in discussions to bring back the firing squad as one of its execution methods.

Last Friday, Utah’s House of Representatives voted 39-34 to approve the firing squad idea. Both houses of the state legislature are controlled by Republicans, and Republican Gary Herbert sits in the Governor’s office. Herbert has kept a tight lip about whether or not he would sign the bill in question.

Apparently the firing squad has not been a very distant memory in the Beehive State. Naturally the state offers the typical lethal injection, but it also allowed the authorization of firing squads to inmates who selected that form of execution over lethal injection prior to May 3, 2004. While death-row prisoners still have the right to choose that option, the state might bring it back on a wider scale because of new concerns about lethal injection not working correctly. Advocates of this bill cited cases from Arizona and Colorado where the lethal injection was botched and led to Supreme Court challenges of that method of execution.

Of course, in addition to these advocates there are also those who oppose the bill, namely the 34 representatives who voted against it. Many of those believe that the death penalty should be abolished altogether.

Rep. Paul Ray, a Republican from Clearfield who is sponsoring this measure, claims that a team of trained marksmen is more humane and provide much faster death than the drawn-out process of a possibly botched lethal injection. Now the bill in question would simply call for a firing squad if the state can not get the drugs needed for the lethal injection 30 days in advance of the execution. What is interesting is that there are several different kinds of lethal injection. Some states, including Utah, use a three-drug cocktail, whereas other states like Texas use a single drug.

Now that this has passed in the Utah House it is in the hands of the Senate and no one really knows which way it will go.

I’ve talked about immigration a lot in the past, it’s a pretty big issue here in Texas. On Monday, Judge Andrew S. Hanen of the Federal District Court for the Southern District of Texas in Brownsville prohibited the Obama Administration from carrying out immigration programs announced in November 2014. These programs would allow protection from deportation and give work permits to nearly five million undocumented immigrants. One of those many programs was supposed to start today, but that’s not happening now.

Hanen found that the state of Texas, as well as the 25 other states that had filed against this initiative, had satisfied the minimum legal requirement to bring the lawsuit, stating that the Obama Administration failed to comply with the basic procedures required in order to put the program into effect.

Of course, White House Press Secretary Josh Earnest stated that the administration was “within the bounds of the law” and implied that it would be appealing the decision. Any appeal in this case filed by President Obama would be handled by the Fifth Circuit Court of Appeals in New Orleans.

Texas Gov. Greg Abbott stated that “Judge Hanen’s decision rightly stops the President’s overreach in its tracks.”

All of the states that oppose this measure argue that President Obama has very clearly violated the “Take Care Clause” of the U.S. Constitution, which limits the scope of presidential power. Only time will tell what will happen next, though one thing’s for sure: it will be a long, drawn-out process but it’ll be fun to see how things turn out.

Hey y’all!

I am an avid social media user. I love all things social media but I have yet to cross the line into obsessively taking selfies and sending them off to anyone, let alone posting them all over the Internet. In today’s world it is almost impossible to find someone who has not taken one selfie and sent it to at least one other person. But one teen not only crossed the line in selfie etiquette, he showed how much he doesn’t value life.

Maxwell Morton, 16, faces first-degree murder charges, in addition to charges of criminal homicide and possession of a weapon by a minor, after shooting Ryan Mangan, who was also 16, last Wednesday.

A funeral was held for Mangan on Monday in a small town just outside of Pittsburgh.

Morton was dumb enough to photograph what he had done and then used the popular social media app SnapChat to send it to another boy. SnapChat allows the user to send a multi-media message that disappears within a few seconds once the recipient opens it. Thankfully the young man that Morton sent the image to was smart enough to save the image, show his mom, and then contact the police.

Morton also had taken a photo of himself with the 9 mm pistol that was used in the shooting, which was later found on the camera roll on his phone.

The amount of disregard for human life that Morton has is just sickening, and the fact that more and more social media is used for this kind of thing makes me want to delete all my apps and go back to an old school flip phone that would only allow you to make calls or send text messages..

Morton is being charged as an adult and could face up to life in prison. Life in prison. I think he deserves the death penalty. Something that the state of Pennsylvania does in fact still have in effect. Pennsylvania ranks 26 in executions for the past five years.

I have to wonder where this kids parents were, why he wanted to kill Mangan and where did he get the gun? Only time will tell.

Just a few short months ago there were some very serious rape allegations being thrown around based on a Rolling Stone article about a student at the University of Virginia. It was a very traumatic account of a young woman being raped by several young men at a frat party, and that she didn’t report it until telling the story to a Rolling Stone writer several years later. When the administrators at UVA found out about these allegations they shut down the greek community and launched a full investigation only to discover that the story was falsified. Aside from the false accusation, UVA’s response seemed to be a little too late–only after this story got massive amounts of media attention did the school attempt to do anything.

That is not the case in regard to a student at Stanford University. Every news report I have seen calls this accused rapist a “former student,” but that status came about after the school found out about what he had done. Brock Allen Turner was charged with five felony counts of suspicion of attempted rape and penetration with a foreign object.

According to prosecutors, the attack occurred on January 18 when two young men riding their bikes on campus came across the scene of the crime. Turner was seen on top of an unconscious young woman; when confronted by the bikers he tried to run away, but luckily these guys were able to catch him and hold him until the police arrived.

A spokeswoman for Stanford University, Lisa Lapin, stated that Turner voluntarily withdrew from the university and is never allowed to re-enroll. I have a feeling that the school gave him an option and he took it, maybe to save face especially since he pleaded not guilty to the charges just yesterday morning.

Stanford did the right thing by shutting down what could have been a massively negative mark against the school. The best part in my opinion? The school had a resolution before the news even broke and was able to release a statement to news outlets immediately, letting people know that it knew what was going on and already had a resolution from an academic standpoint. Universities everywhere, take note!

Remember the days when you felt safe at school? Yeah. I don’t either. Ever since the shooting at Columbine High School in 1999 there has been a sense of uneasiness that goes along with walking into a school. I was only in eighth grade when Columbine occurred but it seems to me that event was a catalyst for even more shootings at schools. I always took it from the perspective as a student and not ever thinking about the teachers. They are adults, they will know what to do to keep us out of harm’s way. Unfortunately it is part of their job. I may not have always liked my teachers but I always respected them.

Respect for teachers has gone out the window. Of course, I could make a bad joke about all of the female teachers who have been arrested for praying on students for sexual purposes and the lack of respect these women have for themselves and their profession, but I won’t. What is frightening now is that teachers are being attacked by students. Physically attacked by students for the dumbest reasons.

Last week a New Jersey student attacked a teacher. No, I’m sorry this kid did not just attack a teacher, he body slammed the teacher to the floor and it was all caught on video by another student. I wouldn’t say it was a full on, aggressive body slam but this kid picked up the teacher and put him on the ground. In the video you can also hear a faint smack which leads me to believe that the student hit the teacher.

The reason for the assault? The teacher confiscated the student’s phone during class. Is a cell phone that important that you want to get yourself into a situation where you physically harm a teacher? I think not. The teacher is a 62-year-old man just trying to do his job. The student is a 16-year-old freshman who has been suspended from school and was arrested and charged with third-degree aggravated assault.

John F. Kennedy High School in Patterson, New Jersey is where the assault took place. The school district filed a formal complaint against the student and suspended him. The Patterson Police Department arrested and charged the student with assault.

I don’t blame the physics teacher for taking away a student’s cell phone. I will ask again, was losing your phone for the length of a class period worth harming a teacher? I still don’t think so. The lack of respect that kids have for authority these days is insane.

I blame parents. Respect starts at home, keeping your hands to yourself starts at home. I strongly believe that the parents should be punished for their child’s bad behavior as well until they hit the age of 18.

Teachers walk into classrooms every day with the mission of guiding young minds, filling them with knowledge to make themselves and society a better place. Teachers have a job to do, they shouldn’t have to worry about whether or not they are going to have to physically defend themselves from their students. Many people have commented that they were surprised that the teacher in this tragic assault did not defend himself. I think he made the right decision; had he tried to defend himself he very well could have lost his job, but also could have been put into a more dangerous situation. The teacher remained as calm as possible while making sure that he kept some composure and held his body stiff so as not to do any more bodily harm.

I applaud this teacher for doing his job and not allowing some 16-year-old punk to destroy his life. Once that teacher lays a hand, in self defense or otherwise, he would have to live with those consequences for the rest of his life. Just like this 16-year-old kid will.

Remember when Neil Patrick Harris played Doogie Howser, M.D in the early 90s? A teenager who was so brilliant that he had gone through medical school and was practicing medicine by age 14, but also went through two occurrences of pediatric cancer.

Recently a 17-year-old boy in Florida posed as a doctor for about a month without anyone even noticing. According to reports, a patient at St. Mary’s Medical Center in West Palm Beach informed staff that a juvenile was dressed in a lab coat and was inside an OB/GYN exam room. The young man was not in the exam room alone, he was with a patient and another doctor. My first question is why did this other doctor allow him in the room? Shouldn’t the real doctor know the other doctors in the department? If I were that patient I would feel really violated and consider suing the hospital.

I’ve spent my fair share of time with doctors and whenever one has someone tag along at an appointment, he introduces me and explains why the other doctor is in the room with us. It’s usually an intern or a new doctor to the department who is being trained to work with patients. This was not one of those instances, this was no Doogie Howser!

The mother of the young man posing as a doctor states that her son is under the care of a doctor but is not taking his medication; his illness is undisclosed.

Police in West Palm Beach have opted not to charge the young man with anything. Not much information can be released due to the boy’s age and I am sure there is a great reason for not charging him but I would certainly have an issue with that hospital.

What’s even more interesting is that another 17 year old, Matthew Scheidt, was charged and found guilty of impersonating a physician’s assistant and practicing medicine without a license back in 2012, also in Florida. That teen was convicted and faces up to 25 years in prison.

In both situations the teenage boys were said to have mental illness, so why did one get off scot-free and the other didn’t?

Hey y’all!

As I’ve mentioned before, I just took the LSAT and have started the process of applying to law school. One of my top choices is South Texas College of Law, which is located in Downtown Houston and has a great reputation. While researching law schools I came across an interesting–and to be honest shocking–new addition at South Texas. The school recently started the region’s first Oil & Gas Law Institute. The shocking part is that such an institute didn’t already exist, considering how big the oil and gas industry is here and how badly it always needs lawyers.

Houston is the capital of the oil and gas business. Everywhere I turn there is another oil and gas company or a company that has some kind of association to that industry; Shell, BP, ExxonMobil, Technip, Worley Parsons, and Mustang Engineering are all here. These six companies are within a two-mile radius of my house and there is no escaping them. I’ve also considered a law career in the oil and gas sector; it makes sense being a native Houstonian with plans to stick around here for a while longer.

Establishing this Oil & Gas Law Institute will allow South Texas to respond to the more specific needs of the energy industry by which its surrounded and promote better education and training for students interested in working in that sector.

The idea is that this Institute will mostly concentrate on creating applied petroleum-related transactional, regulatory, and title practice skills. Christopher Kulander, a visiting associate professor at South Texas, has been appointed the Institute’s, and he has quite the resume; he taught oil and gas law for three years at Texas Tech University (wreck’em!), is a legal writer, is used as an expert witness, and frequently gives presentations about the oil and gas industry, not to mention he is also Of Counsel at Haynes and Boone, LLP.

Kulander states that one of his “main goals is to make the third year in law school much more specialty-focused and practice responsive” for those interested in going into this particular field. The Institute also plans to place advanced students in the legal departments of Houston oil and gas companies, a great way to get in the door of these corporations, which is no easy feat. There are also hopes to expand the areas of study in the Oil & Gas Law Institute with courses focusing on international petroleum transactions, midstream and downstream oil and gas activities, as well as other sources of energy.

This is a small step into a massive industry that definitely needs lawyers on its side.

I have always been partial to the ‘Don’t Mess With Texas’ slogan; it gives a good heads up to anyone who wants to break the law or cause a ruckus in this great state! Osiel Cárdenas Jr., however, apparently did not get that memo.

Osiel Jr., son of former drug lord Osiel Cardenas Guillen, was reportedly arrested by U.S. Customs and Border Patrol agents after they discovered nearly 500 rounds of ammunition and tactical weapons gear hidden in different parts of his sweet Cadillac Escalade SUV. Junior was attempting to cross a bridge going over the Rio Grande that connects South Texas to Mexico but got caught. He admitted to the items being his and to knowing that it was illegal to smuggle them into Mexico. What a winner–his dad must be so proud.

The inspection of the Cadillac Escalade SUV uncovered 290 rounds of 9mm ammunition, 161 rounds of .223 caliber ammunition, 29 rounds of 7.62 mm ammunition, two .223 rifle magazines, and other tactical weapons gear hidden in various parts of the car that included the glove box, center console, and a factory compartment behind the stereo buttons. A pat down of Osiel Jr. also brought to light 14.2 grams of marijuana hanging out in his underwear. That’s a strange place to keep your pot but hey, to each his own.

Osiel Cárdenas Jr. is scheduled for a hearing at a detention center tomorrow. The realities of smuggling across the border are real. If that is going into Mexico I can only wonder what is being brought into the states that we know nothing about. Border Patrol is a vital part of keeping this country safe and a lot of that comes through Texas.

Earlier this week a 15-year-old girl and her 11-year-old sister were involved in a shooting at their rural Florida home. The older girl fatally shot her brother while he slept.

My first question when reading about this was, where are the parents? I bet you are wondering, too. Well the father is a truck driver who had to work from Sunday until Tuesday. That makes sense, so then where was the mother? She apparently went with her husband, leaving their 16-year-old son in charge of the household. I’m sorry, that doesn’t sound like good parenting to begin with. I would not let my children be supervised by my 16-year-old son, I would have a babysitter come or maybe only one parent should’ve gone. Perhaps the one with the job? I don’t see why the mom felt the need to leave her children. Not only did these parents decide to leave their son in charge of these girls, but also their three-year-old daughter. That’s a lot of responsibility for a teenager, and not the best idea on the parents’ part.

Reports claim that the boy locked his 15-year-old sister in her room and then fell asleep. The girl talked her 11-year-old sister into letting her out as he slept. Once freed from her room she headed into her parents’ bedroom where she knew they kept a gun; however, this young girl did not just walk through the door into the parents’ bedroom, oh no, she had to go to the outside of the house with a knife and remove the air conditioning unit that was installed in the bedroom window in order to get in, as they apparently had locked their bedroom door before they left.

The girl headed straight to the location where her parents kept their pistol, loaded it, and went into the room where her brother slept, pulling the trigger. The scary part is that the 15 year old knew what she was doing and told her 11-year-old sister to hide in a closet before she killed their brother.  After shooting her brother she buried her head in a pillow before returning to the living room to find her three-year-old sister trying to wake up her dead brother. Upon seeing this, the two older girls fled the house, leaving the three year old to fend for herself next to their dead brother. It was only after the 11 year old called a friend for a ride that police were able to find the girls.

The parents were notified and have admitted to locking up the 15 year old for up to 20 consecutive days in her bedroom for “misbehaving.” Through police reports and interviews it has also been discovered that the 15 year old had a single blanket and a bucket to use the bathroom when she was locked up.

Things make a bit more sense when you realize how neglectful and irresponsible the parents were. It’s hard to know what possibly happened to lead to being locked in the bedroom. Did the brother beat his sister before locking her in her bedroom? She could have just snapped and felt like she needed to protect herself and her siblings. Although I understand that, I feel like it was also premeditated. She knew where the gun was located, that it needed to be loaded, and to protect her little sister from seeing what was about to happen.

The 15- and 11-year-old girls are being held at a juvenile detention center while a prosecutor decides whether they should be tried as adults or not. The parents are also facing charges of child neglect and failing to supervise.

California Governor Jerry Brown signed a bill in September to remove plastic bags from checkout counters at grocery stores and supermarkets like Wal-Mart and Target starting summer 2015, and 2016 at convenience stores and pharmacies.

Many businesses don’t agree with this ban and have started to collect signatures in order to put a referendum on the ballot in November 2016. American Progressive Bag Alliance, a trade group for plastic bag manufacturing, claims to be turning in about 800,000 signatures. The group really only needs 500,000 valid signatures to qualify for the referendum but it could take several weeks for the counties to determine if all of the signatures are valid.

There are already about 100 counties in California that ban plastic bags, but it is not required for the whole state. It’s no surprise that San Francisco and Los Angeles are two of the cities that already have this ban.

I like the idea of banning plastic bags; it helps the environment. But I don’t like the idea that if you forget to bring your own cloth bags with you then you either have to purchase new ones or you pay ten cents per paper bag. That can start to add up after a while. When I go to the grocery store I go to get things to last me for a week or two, not just a couple of days. I tend to walk out with a ton of bags at once, not just two or three. I don’t imagine everyone shops for just a day or two in advance; grocery shopping takes time out of an already busy day for most.

The majority of Californians support the ban on plastic bags, but why not allow those people who do not support it to still use plastic without a fee? For everyone who likes the ban, continue using your cloth bags and doing what you do!

When most people think of Texas one of the first things they associate with this great state is guns–and they would be correct. Texans love their guns! And now lawmakers in the Lonestar state are considering expanding our gun rights.

According to Fox News, Governor-elect Greg Abbott was very open about this the day after his election in November: “If open carry is good enough for Massachusetts, it’s good enough for the state of Texas,.”

Texas has had an open carry ban since the 1870s and I think it might be time to reevaluate those laws. The whole purpose of the original ban of carrying handguns was “when the carpet-bagger government was very anxious about former Confederates and recently freed slaves carrying firearms.”

There are now about 810,000 registered concealed handgun license holders in the state. That is the entire population of San Francisco.

Despite the early momentum of this idea, there are no guarantees open carry will even pass. Bills to allow concealed handguns on college campuses appeared to have huge support in 2009, 2011, and 2013, but they didn’t go anywhere due to objections from universities and law enforcement.

There are plenty of Texans who have their concealed handgun license, so we already know that at least those people are carrying guns. Why not let them show that they are carrying the gun instead of hiding it from all to see? Some people get a certain level of comfort from knowing that they could protect themselves if need be.

I do understand the objections of universities allowing handguns on campus. There haven’t been many shootings on campuses in Texas; but one notorious shooting could keep most universities on edge. Back in 1966, Charles Whitman climbed to the top of the University of Texas Tower with three rifles, two pistols, and a sawed-off shotgun. This guy was an ex-Marine and an architectural engineering major at UT who had already murdered his mother and wife before going to the UT Tower and continuing his killing spree. He had perfect aim at the five-block radius below to kill whomever he wanted. It took 96 minutes to take Whitman down, but 43 people were shot and 13 of them died. That is one chilling tale and enough to have anyone want to oppose an open carry law. However, Charles Whitman was a very sick man and there have been steps taken to prevent something like that from happening again.

Texas has the most federal firearms license holders in the country. The state allows public displays of long guns, such as rifles and shotguns. Concealed handguns are allowed inside the Capitol, where license holders can bypass metal detectors. And yet Texas still insists that handguns be concealed.

According to Fox News, most of the country already allows some form of open carry of handguns but Texas, California, Florida, New York, Illinois, and South Carolina–which make up more than a third of the U.S. population–do not.

A majority of the open carry bills already filed for the upcoming session would still require a license. One, by Rep. Jonathan Stickland, R-Bedford, would eliminate the licensing requirement for concealed or open carry. This is something I don’t agree with. If you are going to openly carry a gun around then you need to have a license. You need to have something that says you understand how to use the gun, what the gun laws are, and what kind of power a gun has.

Texans love their guns. I was raised on how to use them but also how to respect them. It is a culture down here in the South. By all means allow us to show that we have a gun but still make sure that those who carry have the same knowledge and respect for those guns.

There are some things that I have a hard time understanding and this is one of those instances. Columbia Law School has announced that it will allow its students to postpone their exams.

Why, you ask? Well my lovelies “the law school has a policy and set of procedures for students who experience trauma during exam period,” reads interim dean Robert Scott’s message to students this weekend. “In accordance with these procedures and policy, students who feel that their performance on examinations will be sufficiently impaired due to the effects of these recent events may petition Dean Alice Rigas to have an examination rescheduled,” Scott continued. Scott is referencing the recent non-indictment decisions in the Michael Brown and Eric Garner cases.

I understand that there are some differences of opinion in both cases over the grand juries’ decisions, but for a law school to concede to the notion that its own law students have been traumatized by them is just baffling. These students are literally spending entire months learning about the law but somehow may not be able to handle the outcomes of our justice system? Where is the logic in that? Columbia Law School just basically said that its law students do not understand the very thing they are learning.

Should a student have his own opinion and perspective on a subject? Absolutely! But should he be allowed to take advantage of the situation and get away with postponing his exams? Absolutely NOT!

If students cannot handle the decision of a grand jury, and fully understand that process, then they should drop out of school and find a new profession. Not everyone is indicted. Not everyone wins their case This should be the perfect time to teach students about the process, not coddle them. Plus, let’s be realistic: some of these students will take full advantage of a situation to buy themselves a little more time to study or do things they otherwise would not be able to do if they actually took their finals on the dates already scheduled.

Interim Dean Scott also states that “for some law students, particularly, though not only, students of color, this chain of events is all the more profound as it threatens to undermine a sense that the law is a fundamental pillar of society designed to protect fairness, due process and equality.” So, what it seems that he’s saying is that law students could very well have lost their respect and passion for the law because the grand jury’s made a decision based off of facts and testimony? I’m more miffed by the fact that this man thinks that law students will lose respect for the law because the grand jury did its job!

Laws are not perfect, people are not perfect and things don’t always go the way that you want, but to not be able to handle that reality is concerning.

I can appreciate that Columbia Law School is trying to take care of its students but this is not the way to go. Embrace the controversy and make this a learning moment for all.

A couple of weeks I wrote about Rolling Stone’s report of a young woman being brutally raped on the University of Virginia campus. Last week Rolling Stone retracted the story, even apologizing to its readers. After the original report hit the news cycle people hung on to every word–even the administrators at UVA took action by banning all fraternities–but now it seems that the story may not have been true.

In my first article I was conflicted about the story of Jackie–the victim–and wondered why she would value her reputation at the school by keeping quiet for so long over her own well-being and justice. I get that being raped by five to seven guys is a traumatic event, one that no one would ever want to relive, but why would you allow your “friends” to talk you into keeping something like that quiet, as the report indicated? Why allow seven rapists to troll the campus for another possible victim?

I believe in the theory that there are three sides to every story, and in this case those sides belong to the victim, the unnamed rapists, and the truth somewhere between the two. One person’s perspective on an event can be totally different from someone else’s, so combining both stories usually brings out a more accurate truth, in my opinion. What Rolling Stone  did was allow Jackie to tell her side of a story without sufficient due diligence on the part of the publication by contacting the men she accused and fact checking the story. Granted, I don’t know how much fact checking you can do when a young woman states she was raped two years ago. Yes, you can check to see if such a party took place at the frat house, but there isn’t much more access someone can get without starting to raise flags. Rolling Stone‘s journalism in this case was abysmal.

My biggest question is would UVA administrators have taken the time to do a thorough investigation if this were privately handled? I would like to think so, but the cynic in me knows that sometimes administrators put the reputation of a school above the well-being of its students.

I’m ashamed of Rolling Stone, not just because of this article but because of several missteps over the last couple of years. The cover where it got the facts wrong on who signed the Constitution–a staple of being an American. The RIDICULOUS decision to put a terrorist on the cover of its magazine where he looked more like a rockstar than an enemy of the state! Fact checking and respecting Americans is clearly not on the agenda over at Rolling Stone. Maybe you guys should stick with what you know–entertainment. But really, you shouldn’t even do that because those reviews are usually wrong, too.

Fellow Law Streeter Anneliese Mahoney wrote about how Rolling Stone’s retraction affects rape victims in America. I agree with her, the original Rolling Stone article and later retraction are going to make real victims of rape shy away even more from reporting their experiences. UVA administrators and investigators disproved certain facts that Jackie reported to Rolling Stone. Why couldn’t this publication have taken a little more time and done the right thing? Why did it not take a step back and try to get a full story? Look at the big picture? Yes, it was probably trying to do a good thing in telling this story. So many women feel like they were not alone and were encouraged to tell their story because somehow Jackie found the strength to do it. But now that “strength and courage” have been squashed by reality.

It’s Go Ask Alice all over again. The diary of a young girl that was in fact fictional but presented as truth. There is a certain level of betrayal from the publishers of Go Ask Alice and the people over at Rolling Stone. You want to help rape victims? Try doing your job and not ruining what victims have worked so hard for. That 5.9 percent of false accusations that Anneliese mentions are the ones that are heard the loudest and hung on to the longest. Those who cry wolf are the ones doing the most damage to real victims and Rolling Stone may have just let someone cry wolf on the main stage with a loud speaker.

I’ve shamed Rolling Stone. I’ve shamed UVA. I’ve even shamed Jackie. But now it’s time to reiterate that even though her story as published in Rolling Stone may not be true, anyone who is a victim of rape–or any crime–should find the strength in themselves to speak up. Be what Jackie was supposed to be–a role model who is taking charge of what happened to her and standing up for herself and victims alike.

Don’t let Rolling Stone take away your power.

Hey y’all!

As you probably know, marijuana is now legal for recreational use in Colorado and Washington, and soon it will be legal in Alaska and Oregon, along with possibly Washington, D.C. pending Congressional approval.

I was surprised to see recently that the University of Denver’s Sturm College of Law will be offering a class on the laws of marijuana beginning in January 2015. Created by professor Sam Kamin, the course is called “Representing the Marijuana Client” and it intended to instruct law students on how to represent parties in cases involving marijuana as a result of the wave of state legalizations. According to Kamin, “topics covered will include regulatory compliance, criminal defense, contract, banking, tax, real estate, and multidisciplinary practice. It’s not going to be a joke.”

I don’t think that this class is a joke at all. In fact, I love the idea! Obviously it is legal now in several places and people will need to know their rights–or really their lawyers will need to know their rights. It’s what they are paid to do!

I am in the process of applying to law schools, and before applying I took a very long time to see what various schools had to offer. I love a program that can separate itself from others and really show that it cares about the future lawyers it’s teaching. The University of Denver’s Sturm College of Law is able to recognize times are changing and so should some of its courses. Taking a class on the legalization of marijuana is vital to the lawyers and citizens of the states where it is legalized. Knowing your rights is the best way to stay out of trouble!

Sometimes I run across a story that gives me a chuckle that I feel needs to be shared. This is one of those times. Last Tuesday evening in Paris, France, two men walked into the Cartier store located on one of the most iconic streets in the world, the Champs-Élysées, and robbed the place. Not only did they steal from Cartier but they led police on a brief chase and even took a hostage.

Both men were armed with AK-47s when they walked into Cartier demanding the jewelry be taken out of the display cases. Of course the men were interrupted by the sirens of the police who were on their way. The men dashed out of Cartier with the store manager as their hostage, but they let him go so the two guys could hop on their getaway scooter. The robbers fired shots into the air before losing their balance and toppling over. Forced to flee on foot, the robbers eventually made their way into a hair salon where they took a second store manager hostage.

One hundred French police were mobilized to the hair salon–even a helicopter was sent out. A hostage negotiator was able to talk the guys into releasing the manager and turning themselves in. The whole episode went down in under two hours.

One police officer was wounded by a bullet fragment and of course one of the suspects was injured during the scooter fall. France has seen several high-profile robberies of luxury jewelry stores in recent years. I wonder if this is a trend? Paris does have some of the best high-end shopping in the world!

I love a story like this because it is so dramatic and feels like it really should have been a scene in a movie and not reality. Only in Paris would men rob a Cartier store, flee on a scooter, and give up in a matter of hours. Oh how I love the French!

You might have missed it with all the huge news events within the last week, but there was a Rolling Stone article published last week about a young woman who was the victim of a heinous crime. Seven (yes, SEVEN) young men at a fraternity party raped the woman over a three-hour period. The rape took place two years ago, but now that the story is out UVA President Teresa A. Sullivan has decided to shut down all fraternities until at least January 9, 2015. There will be an investigation conducted during the suspension.

I read the Rolling Stone article and the details are mind boggling. Not just of the before and after but of the rape itself. It was horrifying. After the victim, Jackie, was raped she was able to locate her “closest” friends and tell them about the incident, which resulted in a decision I do not understand. One friend wanted to take her to the hospital immediately while the other two were more concerned about her reputation at the school. I’m sorry but those two kids were NOT your friend, Jackie. When your friends are more concerned about your reputation than your wellbeing, you need to take a good hard look at those relationship. I realize Jackie was in a horrible state but the friend who said she needed to go to the hospital should have put her foot down and taken her. According to the report her dress was drenched in blood and she needed to see a doctor.

I understand that life on a college campus can sometimes be difficult but what is more difficult–having people talk about you for a few weeks because you were raped and reported it or walking around on campus knowing that at some point you will run into your rapists, knowing what they did to you and that they are just living their lives like nothing happened?

I respect the school’s decision to shut down the fraternities and investigate but all of the evidence that was needed to prosecute these scumbags is gone. All that is left is eye witness accounts that aren’t really that reliable, especially after so much time has gone by. I worry about students on any college campus who are more focused on their reputations than justice when a crime is committed.

I love a good football story, but I am a little bit tired of all of the crappy ones coming out of the NFL these days. Ray Rice likes to hit women, Adrian Peterson is suspended for the remainder of the 2014 season, and now the DEA raids teams at away games.

The DEA showed up unannounced on Sunday after several games to check on the visiting teams and medical staff. The San Francisco 49ers’ staff was checked at MetLife Stadium in New Jersey after playing the New York Giants; the Tampa Bay Buccaneers’ staff was checked at the Baltimore-Washington International airport after playing the Redskins; and the Seattle Seahawks confirmed via the team’s Twitter account that they were spot-checked as well after they played at Kansas City against the Chiefs.

“DEA agents are currently interviewing NFL team doctors in several locations as part of an ongoing investigation into potential violations of the (Controlled Substances Act),” Drug Enforcement Administration spokesman Rusty Payne said Sunday. Of course there were also no arrests because we all know that would be plastered all over the news. Does this show that the NFL is doing what it’s supposed to be doing? Surprise, surprise the NFL might actually take something seriously when it comes to its players!

The DEA claims that the teams involved were not specifically targeted, but rather they were chosen because they were travelling and the DEA wanted to see if visiting clubs were in compliance with federal law. DEA agents requested documentation from the visiting teams’ medical staffs for any controlled substances in their possession, and for proof that doctors could practice medicine in the home team’s state.

The investigation was triggered by a lawsuit filed in May on behalf of more than 1,200 former NFL players going all the way back to 1968.

The lawsuit alleges that the NFL and its teams, physicians, and trainers acted without regard for players’ health by withholding information about injuries while at the same time handing out prescription painkillers such as Vicodin and Percocet and anti-inflammatories such as Toradol, to mask pain and minimize lost playing time.

The NFL is also trying to finalize a $765 million class-action settlement reached in August 2013 over complaints by thousands of former players that the NFL concealed the risk of concussions.

I have a hard time wrapping my head around certain lawsuits. Guys, if a team doctor is handing you drugs and you feel uncomfortable with it, why not just say no? Or get a second opinion? You do have the right to refuse treatment and see another doctor outside of the NFL world. You might have to pay for the visit yourself but I’m pretty sure you make enough to afford a visit to a doctor who will tell you the truth and let you know what you should be on. I understand that the team physicians are supposed to be there to help out the players, but let’s be honest about where the loyalty really lies. Players don’t sign those big fat checks those doctors are cashing.

Apparently there is a serious problem in Minneapolis where students classified as minorities are being suspended at a higher rate than other kids. Except the district that Minneapolis School Board Superintendent Bernadeia Johnson represents has about 32,000 students, 70 percent of whom are “people of color.”

Johnson has implemented a new policy that non-violent suspensions given out to minority students must undergo a review process by the district. Shouldn’t any non-violent suspensions be reviewed no matter the color of the students’ skin if it is going to really work? Johnson claims that there is a ‘racial suspension gap’ that she is working to correct.

This new policy will also expand local government, with staff increases, the creation of a stronger data system, clarified suspension rules, and an increase in community and student engagement. Shouldn’t there already be clarifications on suspension rules? Obviously teachers and administrators are suspending these kids for a reason. There is some kind of disruption going on in the classroom that requires them to be removed.

I have never believed in suspending a kid who acts bad. In the eyes of a kid who gets suspended it is just an extra day off from school. One less day to worry about an assignment and they can do whatever they want.

I like the idea of giving more work to the local government and creating more jobs, but I don’t think it is right to second guess teachers. Lay out the rules and guidelines that the teachers should follow and they will follow them. Teachers are educated people who were hired to educate our youth not babysit them only to be second guessed when it comes time to implement the rules.

Let’s also take a moment and really see that everything is racially charged these days. I can’t turn on the television or read through a news outlet without seeing something about race and how one group is being treated more unfairly than another. For such an open-minded society that is supposedly desegregated, we certainly do spend a lot of time looking at the color of someone’s skin and not what’s underneath. Maybe if we didn’t have such a superficial culture we would be more advanced instead of on the decline.

Hey y’all!

I hope everyone had an awesome Halloween weekend! I spent the weekend in Chicago where I was surprised to see many homeless people sitting in front of some of the most expensive shops on Michigan Avenue. Houston certainly has homeless people too, but nothing like what I saw in Chicago, where I felt like we were pretty much stepping over people who were at their rock bottom. My boyfriend has a kind heart and on several occasions this weekend gave food to the homeless, and I thought that was really sweet. So I found it really ironic when I read the news that two pastors and a 90-year-old man were charged with feeding the homeless in Ft. Lauderdale.

Arnold Abbott has been feeding homeless people in Ft. Lauderdale for nearly 20 years! He heads a group called Love Thy Neighbor and was only able to get out three or four meals of the 300 that he had prepared for the day before the cops shut him down. Abbott, Rev. Mark Sims of St. Mary Magdalene Episcopal Church in Coral Springs, and Rev. Dwayne Black, pastor of the Sanctuary Church in Ft. Lauderdale, were each cited for willfully violating a city ordinance. Police issued them notices to appear in court where they could be asked to explain their actions. Explain their actions. Why do good people have to all of a sudden explain the actions of giving a helping hand to the less fortunate? Is this the kind of world we want to live in? I know I don’t!

Everyone gets down on their luck at some point and some have it worse than others, but what’s wrong with these people wanting to help the homeless? There is a large number of homeless in the Ft. Lauderdale area, which is why something should be done about that issue. Perhaps the city council should consider creating more shelters instead of taking everything away from them, including the ordinance it passed last Spring banning homeless people from having any possessions in public. They are homeless, where are they suppose to have the few things that they own? I get that the homeless population may be growing in that city, but punishing people who are already hard on their luck is just counterproductive.

Cleaning up your city shouldn’t involve punishing those who are down on their luck and then punishing other people for trying to help.

Hey y’all!

I am a huge fan of going to the movies. I was one of those people who would go to the midnight showing of “Harry Potter” or “Transformers” and all the big blockbusters. Although I never had a real passion for the Batman franchise, it sticks with me to this day with these two thoughts: 1. Heath Ledger died too soon, and 2. The “Dark Knight Rises” movie theater massacre in Colorado.

It’s hard to believe that it has been two years since movie theater shooter James Holmes walked into that movie and killed 12 people, injuring 70, on July 20, 2012. It’s even harder to believe that he still hasn’t stood trial for his crimes. The new date for jury selection is January 20 — this will be his FIFTH trial date.

Why do they keep postponing a trial that seems so cut and dry? Because they keep wanting to evaluate him and find out if he is sane enough to stand trial and get the death penalty that he so rightly deserves!

There have been 22 hours of interviews to determine if this guy is sane. I would say that all signs point to yes! Not because of my personal belief in the death penalty, but because he knew what he was going to do long before he did it. There was a serious plan in motion. The guy even signed up for dating websites and put in his profile, “Will you visit me in prison?” He knew what he was doing and the prosecutors are planning to use that bit of information to prove he was sane. Holmes’ attorneys acknowledge that he was in fact the shooter but that he was having a psychotic episode at the time.

It is time to realize that James Holmes knew what he was doing and get through the trial.

Last week Rachel Craig, 28, from Waynesboro, Virginia was convicted under the state’s new revenge porn law. She faces up to one year in jail and a $2,500 fine. The revenge porn law went into effect in July and it criminalizes posting nude pictures of someone on the Internet without the individual’s consent. Craig was said to have been in an argument with her former boyfriend when she allegedly stole a picture of his current girlfriend from his phone and posted it on Facebook. Craig even took full credit for the act and warned the victim “not to mess with her” according to Sgt. Brian Edwards of the Waynesboro, Virginia Police Department.

Okay. I’m sorry. What!?! I have so many questions. First of all, if he is your former boyfriend why are you still even communicating with him? Secondly, what was she doing with his phone at all? Third, don’t you think at 28 you would be mature enough to not take this to Facebook? I don’t get it. I don’t get the blatant disregard for an innocent bystander and the maturity level of this woman. I also kind of wish there was a stupid clause tacked on to the law to give this girl an extra six months to sit in solitude and think about how dumb this whole situation is. Craig might go to jail and have to fork over $2,500 for something petty that could have been avoided if she just stopped and thought about what was the real issue and not harming an innocent bystander.

Two months ago another woman in Virginia — Crystal Cherry — was also charged with revenge porn because she posted nude photos of her boyfriend’s former girlfriend on Instagram and Twitter just days after the new law went into effect. Again, another one of these women who is dumb enough to take to social media and create issues that could be avoided at all costs if she could just handle her problems like an adult.

I like this law. The only thing that concerns me is that if this is a first-time offense, both Crystal and Rachel will probably not do any time and will just pay the fee. I know prisons are crowded and our tax dollars are hard at work with sustaining life for idiots who like to break the law, but maybe there should be something a little bit more that we could do. Maybe a class on how to not be so stupid? Or teach kids the proper way to use social media?

I like Facebook and Instagram and I admittedly have a serious love of Twitter, but I don’t need to know everything that you are doing. I don’t need to read about your daily drama. And I definitely don’t want to see you posting nude photos of another woman just because you’re mad at some dude who probably won’t matter to you in five years. Craig and Cherry get to be reminded of that every day now for the rest of their lives when they have to include their misdemeanor convictions on any application they fill out.

This month Jennifer Lawrence is on the cover of Vanity Fair and in her interview she mentions the celebrity nude hacking scandal that she was a part of. J-Law called it a “sex crime not a scandal,” and I tend to agree with her. Not only did this hacker violate someone’s privacy but also committed a cyber crime. Hundreds of celebrities’ nude photos were splashed across the internet, violating their privacy. Some people say that when you choose the life of a celebrity you choose to give up your privacy, but I completely disagree. Celebrities are still people. But I will criticize anyone who is dumb enough to take nude photos and save them anywhere. iCloud is not secure. Your computer is not secure. There is always someone trying to hack into something that will violate you in some way and they may just be doing it for the fun or just because they can.

Even some idiot Pasadena, Texas school teacher gave nude photos to a student she was having an affair with who ultimately ended up sharing them with others. Ashley Zehnder, 24, had reported that nude photos of her were being shared throughout the school where she taught. An investigation revealed that she was sleeping with a student who shared them. Will anything happen to the student who was having the affair and sharing the nude photos? Probably not. But Zehnder lost her job, will go to jail, and will probably have to register as a sex offender. Can we say Mary Kay Letourneau?

I think that there is a lesson in all of this. People need to be more cautious about what they are doing and where it is being saved. Craig and Cherry’s victims are on the same side as Jennifer Lawrence and other celebrities. The only difference is Craig and Cherry got caught. Zehnder is the predator and the victim. Her private nude photos were shared with an entire school but she also preyed on a student.

Word to the wise: if you are going to take nude photos use a Polaroid and burn them when you are done if you don’t want them to be shared. Or better yet, just don’t take them. Have a little modesty and respect for yourself. If you want to share being nude do it in person where the only other person looking at you can only use their memory, not a hard copy that could be sent out to the world.

Hey y’all!

I try not to spend a whole lot of time paying attention to the local news in Houston because it’s usually about someone getting killed or the meteorologist getting the weather wrong yet again. But I noticed a tweet from my local outlet about Houston’s mayor Annise Parker doing something crazy. That something crazy is subpoenaing pastors over their sermons.

I will be 100 percent honest and let you know that I am not fond of Mayor Parker. She drives me insane. Not because she is a Democrat or a lesbian but because her ideals of how to run this city are just bananas! (Sidenote: I do really hate how every news outlet constantly identifies Mayor Parker as the “first openly lesbian mayor of a major city.” I mean this with all do respect, but who gives a crap at this point!? She’s been mayor of Houston for four years — time to let that go. This is why we can never be seen as more than our gender and sexuality. Stop identifying people by these two labels — she is MAYOR ANNISE PARKER! What does her sexual preference have to do with running this city? Absolutely nothing! Off my soap box.)

The city’s Equal Rights Ordinance was voted on back in May and is now being challenged for various reasons. The ordinance included a “bathroom” clause that was eventually dropped, which regulated which bathrooms a transgender person could use. Over the summer, opponents of the ordinance delivered 50,000 signatures for repeal— nearly triple the minimum necessary number of 17,269. In this case, good ol’ Mayor Parker — champion of the ordinance — has decided to take away the First Amendment rights of pastors in Houston by subpoenaing the sermons and other communications of pastors who opposed the ordinance and collected signatures in church.

The subpoenas sought “all speeches, presentations, or sermons related to HERO (Houston Equal Rights Ordinance), the Petition, Mayor Annise Parker, homosexuality, or gender identity prepared by, delivered by, revised by, or approved by you or in your possession,” according to the Houston Chronicle.

Churches and pastors are specifically protected in their speech and religious practice under the First Amendment. So why does Mayor Parker and her cronies think it was okay to subpoena their sermons? Let’s just start to chip away at the constitution a little bit at a time until we have no more rights. Who needs rights or to be protected by the law anyway?

I certainly do love how Mayor Parker and City Attorney Dave Feldman have started to back track on everything since the subpoenas were issued on Monday; they are now claiming that they have realized that the subpoenas were too broad. Too broad? You basically want to see everything that is being said about you and stripping away the rights of fellow Houstonians. It’s like the popular girl in high school finding out someone doesn’t agree with her and then demanding to find out everything that is being said behind her back. Grow up! Not even two days after the subpoenas were issued Mr. Feldman received criticism from Texas Attorney General Greg Abbott stating that the subpoenas needed to be withdrawn immediately. Hmmm. City attorney versus Attorney General of the State of Texas. Who do you think has more clout?

Mayor Parker needs to set aside her own personal agenda and do what’s right for the whole city and maybe take into account the reason why she is in the position she is in. Wouldn’t it make sense to know about the laws and the Constitution before trying to get your way? You just made yourself look like a fool, Annise.

Last July a young woman named  Lacey Weld from Tennessee was sentenced to 12 years in prison plus five years of supervised release after being captured on video spending 40 minutes inside of a methamphetamine manufacturing plant by an undercover police officer back in July. Did I mention she was in the last few weeks of her pregnancy at the time? Federal Judge Thomas Varlan determined that “enhanced sentencing” guidelines regarding harm to a child justified six years of the total sentence.

I’ll admit, I had never heard of the enhanced sentencing guidelines so to hear this story was pretty shocking and honestly I have mixed feelings about the whole situation.

A gaggle of reproductive-rights-organizations have taken it upon themselves to call on one-foot-out-the-door Attorney General Eric Holder to come out and publicly condemn Weld’s sentence. I’m curious as to why any of these organizations would want him to do such a thing? His reputation isn’t the best and no matter what he does or says it will not change the facts or the sentencing. In an interview with Vice, Weld’s attorney John Eldridge said that “laws intended to prevent ‘substantial risk of harm to life of a minor or an incompetent’ do not mention harm against a fetus.”

This is where things get sticky. Shouldn’t women be held responsible for their actions even if they are pregnant and especially if they are knowingly doing harm to themselves and their unborn child? Yes, you can argue that abortion would fall under that umbrella point of view, but if a woman has made the conscious decision to give birth to her child and either put it up for adoption or raise it herself, she should be held responsible for her actions.

This case has some serious grey areas and Weld’s lawyers are doing a damn good job of finding ways to interpret the laws in order to benefit her. That’s what lawyers are paid to do. But Weld needs to take a good, hard look in the mirror before she gets out and takes on the responsibility of raising that child. It may be a while but at some point it will be her responsibility again.

Some jurisdictions allow pregnant inmates to raise babies they give birth to in jail for several years before giving them to family members on the outside. This is best exemplified by the Argentinian movie Leonera (Lion’s Den) in which a woman who is convicted of murder finds out she is pregnant and is placed in a special ward of the prison where she is able to give birth and raise her baby for several years before giving him to a family member. It is an interesting concept and it almost seems like a good idea until I realize that our tax dollars would be supporting not only an inmate but also her child. The film in particular explores the pain and struggle of raising a child behind the walls of a prison and the importance of the bond between mother and child.

Lynn Paltrow, executive director of the National Advocates for Pregnant Women, says that  “this case tells women who are pregnant and cannot overcome their addiction is, really, to get an abortion.” I do not believe that is what this case is telling any woman. The point of punishing a person for her crime is to deter her from doing it again and to make an example out of her. Perhaps there is a girl out there who has a drug problem and just found out she is pregnant. By reading this article and she might realize that if she gets caught doing something illegal and harming her unborn child that she has chosen to keep she might be better off focusing on getting clean and taking care of herself and the baby.

Weld missed that opportunity. Not only did she take that away from herself and her child but she has also done irreparable damage. Even breathing in the fumes through a shirt at a meth lab can do damage to a fetus. According to the Department of Justice there is video footage of Lacey not only working in the meth lab but also smoking the drug. Weld told the court back in July that she wanted to “apologize for all the harm and wrongdoing (she has) done to (her) children. He could have died, and (she) just pray(s) and thank(s) God that (her) sister has him and he’s OK.”  Why is Weld just now realizing that she did something wrong and why is she merely apologizing? Shouldn’t she have been more aware of what she was doing before she got caught?

The baby did test positive for opioids and methamphetamine. I think Lacey got the time she deserved and I don’t think that it was wrong for the judge in the case to “enhance” her sentencing because she actually, knowingly did harm to her baby. If you are willing to do the crime, you should be willing to do the time.

I wish Weld all of the luck in the world and hope that she can kick her habit, but I also hope that her little baby has a fighting chance.

Kristine Rodas’ suit against luxury car company Porsche had a major setback last week. Rodas, widow of Roger Rodas who was killed along with actor Paul Walker in a tragic car accident in November 2013 that involved a 2005 Porsche Carrera GT in Valencia, California

Back in May, Roger Rodas’ wife filed a lawsuit against Porsche citing negligence as the cause of death. Court documents describe the Porsche Carrera GT that her husband was driving as an “ultra-high-performance-super-sports car for the road,” that goes from zero to 60 mph in 3.5 seconds with a top speed of 205 miles per hour. The complaint argues that such a high-powered sports car should have a higher standard of crash protection, and that a mechanical malfunction forced Rodas to veer off the road. The lawsuit claims that a “properly functioning crash cage” would have prevented the deaths by preventing “intrusion into the passenger compartment,” damage to the fuel tank, and the splitting of the vehicle in half. A separate investigator was hired to evaluate the wreckage and claims that the car was only going 55 mph instead of the 100 mph that the LA County coroner, LA County Sheriff’s Department, and the California Highway Patrol all cited.

U.S. District Judge Philip Gutierrez dismissed four of the five grounds for the lawsuit, finding that the complaint did not include enough specifics. The case was not fully dismissed however, and lawyers are allowed to amend the lawsuit as filed.

It seems to me that if three separate investigations were done as soon as the incident happened and they all came to the same conclusion, the new investigation would not be warranted or even accurate. The California Highway Patrol as well as the LA County Sheriff’s Department also noted that there were no mechanical defects of the vehicle involved in the crash, but rather it was due to pure negligence on the driver’s part.

I understand that Rodas is grieving and she wants someone to pay for the death of her husband and Walker, but she is pointing the finger at the wrong people. A thorough investigation was conducted when the incident occurred and questions were answered. It’s hard to grasp the loss of a loved one but sometimes you have to realize that a life was lost because of a lifestyle. Roger Rodas chose a life of racing cars and was probably aware of the dangers involved on that path. I feel sorry for the Walker and Rodas families, but this lawsuit is dragging out the tragedy.

Hey y’all!

Yesterday I was watching The Five on Fox News and one of the topics was this new ad campaign that some former Mitt Romney “ad guru” came up with that has me feeling all kinds of different things. Another one of the writers here at Law Street got her fingers working on the same topic and I will address a little of what Anneliese had to say about the “Republicans Are People Too” campaign.

I get the message they’re trying to get across here, but I think it was done wrong. We all have a misconception of people we do not know or do not associate with, and this often goes along party lines. There have always been certain stereotypes attached to each party. Republicans and conservatives are typically viewed as heartless, racist, homophobic, gun-toting, war-loving, wife-beating, feminist-hating, uncaring-about-the-poor, mean-spirited, greedy, selfish, intolerant, drunk, one-percenters. Democrats and liberals are often viewed as tree-hugging, abortion-loving, gun-hating, politically correct, unpatriotic, lazy, looking-for-a-handout, entitled, big government-loving people who like to stick racism or sexism into every conversation.

These stereotypes are not true of everyone and that was what Vinny Minchillo was trying to put out there for the world in this ad. But I don’t think he did it the right way. And if he spent $60,000 to create that ad then he needs to get his money back because the supposed use of stock photos is just embarrassing. Not to mention the stuff he points out is just petty and shallow.

The one thing I do love about the ad is the moment when it states “Republicans like dogs and cats, but probably dogs a little more than cats.” It was the playful humor of this moment that made me like the ad. But to feel like you need to tell the world that even people with tattoos are Republicans drives me insane. I have 14 tattoos, I don’t drive a Prius, I do love dogs, and I’m a conservative, too!

Greg Gutfeld had an interesting point on The Five: “This commercial is not the answer. You shouldn’t be saying ‘we’re just like them.’ You should be saying why you’re better than them. You need to focus on why you’re right.” I like the point he makes but maybe not so much about being better than anyone else but simply saying why we think that our opinions and views are just as important and should be just as respected as those of another party.

Which brings me to the petty comment that President Obama made the other day in a speech:

While good, affordable health care might seem like a fanged threat to the freedom of the American people on Fox News, it’s working pretty well in the real world.

Delusions of grandeur come to mind.

Why on EARTH, Mr. President, do you feel like you need to take jabs at Fox News? Are you threatened by the idea that you have not been such a great president and things are not actually working out the way you said they would!? Someone actually took the time to include this little jab in his speech. President Obama didn’t just go off the cuff and use his own wit to make this comment, but a speech writer actually wrote it in for him. When you are on your second term and this is what you and your speech writing team are talking about it is time to hang up your hat! Take a page from the fictional President Josiah “Jed” Bartlet of the West Wing and respect the other party, maybe even include them.

Yes, Anneliese, real Republicans actually use Macs. In fact, I am using one to write this right now! I love all things Apple; the iPhone 6, iPad mini, Apple TV and I even have two Mac laptops and a 27″ iMac. But now I have to wonder if me listing all of the Apple products that I own makes you think I am, yet again, your typical elitist Republican because Apple products are not cheap! I appreciate that you appreciate the fact that Republicans are just kind of tired of having a bad rap.

Now, I agree with Anneliese on the other ads she talks about — they are just horrible! But you can’t fault the party for trying. What’s even better is that the more you talk about these ads the longer they stick around and the more people they reach! So even if it is a ridiculous ad, you have given it the momentum to influence someone it may not have reached before. Or at least get someone thinking.

Hey y’all!

Two of my favorite things in the whole wide world have collided! The Real Housewives franchise on Bravo TV and the law! Real Housewife of New Jersey Teresa Giudice and her hubby Giuseppe “Joe” Giudice were charged with 41 counts of conspiracy to commit mail and wire fraud, bank fraud, making false statements on loan applications and bankruptcy fraud back in 2013 and yesterday they were both sentenced.

First, “Juicy” Joe.

He received 41 months in a federal prison, has to pay $414,588.90 in restitution, plus a $10,000 fine, and has to complete an alcohol treatment program. It’s great that he has to do the alcohol program, but I think it is a little bit too late for that idea. Back in 2010, good ol’ Joe flipped his truck in a DWI crash but never really got punished for it. After losing his license in that crash, he posed as his brother to get a new driver’s license, and it’s that crime for which he might be deported to Italy — the country of which he is a citizen — after getting out of prison.

Teresa got 15 months in jail; prosecutors argued against house arrest because it would be a little fucked up for her to chill out in the house she basically defrauded others in order to build. The upside is the judge is allowing Teresa and Joe to go at separate times so that their four daughters do not suffer too much. Teresa will serve first and I imagine she probably won’t stay in for the whole 15 months. Think Paris Hilton, Lindsay Lohan, or Nicole Richie jail time. Which makes me wonder if jails are sexist because these women were in jail for short periods of time but DMX and O.J. Simpson were not let out early (but we all know why O.J. is really in jail).

Naturally, Joe and Teresa will sit down and do their first interview after the sentencing with Andy Cohen of Bravo TV. Andy is the glue that holds all of the hot mess shows together on that network and he does a great job!

I am a huge fan of all things Real Housewives. You can get on that hot mess express and ride it around for an hour, hop off and go about your life until that next episode comes on. Originally when I started watching RHONJ I was not too fond of Teresa until she flipped that table.

Joe didn’t seem to be around much at first, but that was okay because there was enough drama to fill more hours than viewers could stand. Slowly but surely over the past few seasons Joe has stepped up his game in showing his face. I HATED Joe a season or two back when he basically made it seem like a phone call he received was from a mistress and then proceeded to call his wife a bitch. Tool bag!

But this season, if you’ve been watching, you get to see a better side of Joe and he has somehow turned into a decent guy. I can tell you one thing, even though I may have never been fond of him or how he treated Teresa he has always seemed to be a good dad!

Teresa and Joe have four little girls; Gia, Milania, Gabriella, and Audriana. Milania stole the show the moment that camera turned to her. She is one opinionated, mouthy kid but you gotta love her!

What blows my mind about this whole situation is that there were 41 counts and all of this spanned a four-year time period. It is great to know that prosecutors were able to catch them and make them pay for their choices but I wonder how much of that is because they decided to join the Real Housewives of New Jersey. If the spotlight had not been on them would they have perhaps gotten away with it or even gone on to commit more fraud?

Our judicial system works, but does it work better when celebrities are involved?

Hey y’all!

I’ll be honest, I have never been a fan of Wal-Mart. I get the appeal of the low-cost products and everything, but I’ve never felt like any Wal-Mart I have ever been in has seemed clean or worthy of my money. I also have a huge problem with all of the lawsuits that seem to stem from Wal-Mart mistreating its employees, especially women.

Back in June there was a fatal accident involving a Wal-Mart delivery truck and a limousine party bus. The party bus was carrying comedian Tracy Morgan and his posse. One man was killed and several injured, including Morgan who was in critical condition at one point. The semi-truck driver had supposedly been awake for 24 consecutive hours and was reportedly going 20 miles per hour OVER the speed limit.

Naturally after all is said and done, Morgan has filed a lawsuit against Wal-Mart because of the accident. I would too if I were him, but he had to see the blame game coming.

Good ol’ Wal-Mart has come out in the last several days to say that because Morgan and the other passengers were not wearing seat belts they are to blame for their injuries. Well Wal-Mart, if that’s the only defense you have then you certainly are scraping the bottom of the barrel. But it is actually a good defense — that’s why the Wal-Mart lawyers get paid the big bucks. I want to be a lawyer, but I could never imagine taking a job for Wal-Mart no matter how much it offered to pay me. With the amount of shitty lawsuits that that company has to deal with I would probably end up retiring early and forced into the nut house. I could never work for a company that has zero respect for anyone, even its own employees.

As for the truck driver, he may have been under some pressure to get his shipment out quickly and maybe was told to overlook the trucking industry regulations because Wal-Mart needs its shelves fully stocked at all times. But then again, does a Wal-Mart-employed truck driver have a different set of rules then what OSHA (Occupational Safety and Health Administration) requires? Have the great slimy lawyers of Wal-Mart found a loop hole? Don’t get me wrong, I love lawyers — I want to be one. But the idea of what Wal-Mart has gotten away with because of its lawyers rubs me the wrong way!

Should Morgan have had his seat belt on while whooping it up in the party bus? Uhm, maybe. Are there even seat belts on a party bus? I’m sure there are, but they are probably so neglected that they have been tucked under the seats by so many people and forgotten. When I think of a party bus I think of a safe driver who creates a safe atmosphere in the bus so that passengers don’t have to think about safety or even seat belts. That’s the purpose of hiring a driver, so you can have fun and be safe with a sober, capable, licensed driver.

Wal-Mart said the injuries were “caused, in whole or in part, by the plaintiffs’ failure to properly wear an appropriate available seat belt restraint device.” The company said that by not using seat belts, the plaintiffs “acted unreasonably and in disregard of plaintiffs’ own best interests.” I’m sorry, WHAT!?! YOUR DRIVER had been awake for 24 consecutive hours and YOUR DRIVER was going 20 mph OVER the speed limit! Your driver “acted unreasonably and in disregard” of his own life and the lives of any other motorists on the highway!

If you look at the pictures from the crash you can see that even if Morgan and his friends had their seat belts on there was enough damage done that it still would have caused injuries. Seat belts are great but just because you are strapped into a chair does not mean that you will not be harmed or even killed.

So to those dear Wal-Mart lawyers, you should reconsider allowing your client to blame Tracy Morgan’s injuries on the fact that he was not wearing his seat belt because I just gave a better defense. Would a judge side with me? Who knows. I’m no lawyer, yet! But if you are any good at your job you would have seen both sides of the coin before allowing a statement to be released blaming someone for injuries that were incurred because of an accident one of YOUR EMPLOYEES caused!

Shame on you Wal-Mart, shame on you!

Hey y’all!

Lately our lives have been beaten down by the constant news about terrorists. It seems like terrorism is everywhere we turn. What happened to the days when we all lived in the nice little American bubble where terrorism didn’t even seem to be a word we could rightly understand? Now it is a word that we use on a daily basis. 9/11 was the starting point of a scary reality for most of this generation and its connection to terrorism. Before that day we could get on a plane and not have to worry about if the person next to us had a bomb in their underwear or constantly wonder and worry about what might happen next. People are unpredictable and you never know what could happen. The security blanket of living in a nation considered a Super Power is no longer there; we walk around with a target on our backs.

Finally our government is getting it together and figuring out what to do to make our world a little bit safer. Even amid all things ISIS at least the government is finally trying to do something. Kudos to President Obama on the airstrikes the other night!

In an effort to deter people from becoming homegrown jihadists, our government has started a pilot program in three cities: Los Angeles, Boston, and Minneapolis. The administration is looking for new ways to intervene in the lives of people who may want to launch an attack on us, even American citizens. The ideas they have put together seem a bit strange and big brother-esque to me, but a necessary evil in terms of protecting the many from the few.

My biggest question though, is how do you know who to look for? How do you know who is thinking or planning anything?

I always think of the film Enemy of the State when it comes to trying to keep an eye on terrorism. What if some innocent person gets pulled into something they aren’t even aware of and the government ruins their entire lives? And once it figures out they aren’t “the guy” it just leaves them alone with a simple apology and they have to to pick the pieces of their life.

How much are we willing to give up to our government in order to be safe? This is something I struggle with all the time because I certainly do not believe in big government, but I do believe our citizens should be safe and protected from harm’s way. Unfortunately there is no right or wrong answer.

Hey y’all!

I was trying really hard to keep my opinion to myself when it came to the Ray Rice, Adrian Peterson, and Jonathan Dwyer domestic violence cases, but I just can’t anymore.

Last night I watched as many different male commentators shared their opinions on ESPN about all things domestic violence and what the NFL should do, and then I read an article this morning that has irritated me beyond belief. Female Soccer star Hope Solo was arrested and charged with domestic violence back in June but there is little coverage of the story. The only news I found about her recently is that she set a new “record while awaiting domestic violence trial.” So Hope gets to live her life, play the sport that she loves, and silently await trial for not only causing injury to a child but also to her sister. Now reports say that she was drunk at the time, which is no excuse! No matter if you are sober, drunk, or have some crazy sleep disorder that causes you to hit someone you should not be left on a pedestal while others are ostracized for causing bodily harm to others as well.

I do not support domestic violence and I certainly have a problem with any woman who states “I don’t believe in domestic violence, but I will say: any woman who can hit a man, a man shouldn’t have to sit there and take the abuse. The abuse goes both ways.” This Ray Rice fan, only identified as Kathy, is out of her mind! No one needs to be laying a hand on anyone in a violent manner. Ever. Both men and women should be able to exercise restraint, you are adults!

Do I believe in corporal punishment? Absolutely. But there is a difference between corporal punishment and domestic violence. Domestic violence is defined as “violent or aggressive behavior within the home, typically involving the violent abuse of a spouse or partner.” Corporal punishment is defined as “punishment administered by an adult (as a parent or a teacher) to the body of a child ranging in severity from a slap to a spanking.”

So while Ray Rice is now an ex-NFL player, Adrian Peterson is on the NFL’s “exempt” list (what is that, like Santa’s naughty and nice list?), and who knows what will happen to Jonathan Dwyer, little miss Hope Solo was able to apologize to the public and go back to work. How is this fair? After all these years of women wanting to be treated as equals we go and do this. We allow a woman to hit not one but two people, apologize, and then go back to work and be praised for a 72nd shutout game with her national team?

Men can’t hit women or children, but apparently women can hit men, women, and children while still being able to go about their lives without being judged by the public and no actions are taken from the league she works for? Yes, her charges seem to be misdemeanors but an arrest and a trial, that is enough for me to feel the need to ostracize her and state that she should have been yanked from the league until her trial was over and resolved.

We do things differently in the south. We were all raised on the idea of getting a spanking. In fact, there may have been a time or two where my Mississippi grandmother would order me outside to the weeping willow tree to grab a switch because I had done something wrong. In all honesty I don’t remember if I ever got a whipping but the threat of it and making me pick out my switch was enough to make me not act up again. I also had a father who was a true military man through and through. I would have to say, in my eyes, my dad was a mix of John Wayne and General Patton. All he ever had to do was give a look and I knew not to do what I was about to do. That is the kind of fear we need to instill in our children today. We shouldn’t coddle them, but we also shouldn’t have to actually harm them, that fear is enough. (For me at least, until I got into my teenage years, but that’s a different story.) I love my dad but even to this day he could scare me to death with that look.

Hope needs a reality check. You don’t get to hit people — even if you’re drunk — and still have a career that influences young women all over the world. Many claim that Rice, Peterson, and Dwyer were role models to children. So is Hope. Maybe, as a parent, you should want your child’s role model to be someone in the community and not a celebrity.

Can we also remember that domestic violence is NOT just violence against women! Women beat their husbands and children, too. We can’t spend weeks talking about the male athletes charged with domestic violence like Rice, Peterson, and Dwyer without acknowledging Solo. It’s sexist and full of exclusion.

German authorities have charged Oskar Groening, 93, with 300,000 counts of accessory to murder thanks to the trial of former camp guard John Demjanjuk in 2011. In a legal first in Germany, a Munich court found that simply demonstrating Demjanjuk's employment at the camp, rather than his involvement in specific murders, was enough to implicate him in the killings committed there. Demjanjuk was sentenced to five years of imprisonment for helping the Nazis kill almost 30,000 Jews during his time at the Sobibór extermination camp in German-occupied Poland during World War II.

Hey y’all!

On Monday, 93-year-old Oskar Groening, an SS guard assigned to Auschwitz concentration camp during World War II, was charged with 300,000 counts of accessory to murder by German prosecutors. Not many of us were alive to experience World War II, but I know someone who was around back then who tells stories like it happened just yesterday. My grandmother, also 93, recounts stories from that time, and my grandfather’s brother was a B-24 bomber pilot who was killed in France in 1944.

So many families all over the world were affected by that war, most notably by one of the most vile men this world has ever seen — Adolf Hitler. More than a million people lost their lives between 1935 – 1945. Groening, in particular, has always been very open about his experiences at the concentration camp. He recounted a horrendous story to German Magazine Der Spiegel in 2005 of witnessing “another SS soldier grab the baby by the legs and smashed the baby’s head against the iron side of a truck until it was silent.”

German authorities are able to charge Groening with these 300,000 counts thanks to the trial of former camp guard John Demjanjuk in 2011. In a legal first in Germany, a Munich court found that simply demonstrating Demjanjuk’s employment at the camp, rather than his involvement in specific murders, was enough to implicate him in the killings committed there. Demjanjuk was sentenced to five years of imprisonment for helping the Nazis kill almost 30,000 Jews during his time at the Sobibór extermination camp in German-occupied Poland during World War II. Demjanjuk was sentenced to five years in jail, which seems a bit unfair given the extent of the crimes, but at 91 a life sentence could possibly only be a few more years than that.

It’s frustrating to know that people like Groening and Demjanjuk were able to live long lives without answering for what they had done. I know that it is difficult to really say what they actually took part in and how much fear they may have had if they went against Hitler, but at some point they made a decision to participate, and that is something they have to pay for. There can be so much hatred and evil in a single person.

There are still more than 20 people remaining for the German courts to prosecute in conjunction to war crimes from War World II, but for now focusing on Oskar Groening is good enough. Every family deserves justice when it comes to the death of loved ones.

In Oskar Groening’s case it isn’t just the families who deserve justice — it is the entire world.

Hey y’all!

Thirteen years ago yesterday our country was shaken to the core. I was sixteen, skipping school and watching some awful show on television when the program was interrupted by the news reporting on the first airplane hitting the Twin Towers in New York City. Not even 20 minutes later, as the news anchors were still reporting on the crash, we all watched as another plane crashed into the second tower. It was live TV and there was no controlling what the viewers were going to see. The confusion and horror coming from the news anchors was something I could never forget. My brother and I sat in silence not knowing what to do, what to think, or what was going to happen next. Parents pulled their kids out of school and I remember this feeling of urgency in the air and the uneasiness of what could possibly happen next. Thousands of people had just lost their lives and the country witnessed it. There were no answers, only questions of why and what will happen next.

Every year we remember that horrendous day. It was a constant fear for the first year or two, but also a great feeling that our country had come together and we had heroes to thank daily. Budweiser aired a commercial during Superbowl XXXVI that really demonstrated the somber tone and respect the entire country had for the events of September 11, 2001. The ad was only shown once to ensure they did not profit from it in any way. Even today, 13 years later, it is the most moving dedication done in such a small amount of time.

Yesterday was a somber day for us all. Most news outlets covered the anniversary in addition to current events. While watching one of the programs I had to do a quick rewind to make sure I was hearing it correctly. Young America’s Foundation had gone to the George Washington University campus in Washington, DC last Friday, September 5, to interview students about the anniversary of September 11. YAF only had a few questions to ask these students:

  1. Next week marks the anniversary of a major national event. Do you know what that is?
  2. Do you know what ISIS is?
  3. Did you know that ISIS is responsible for the beheading of two American journalists? If so, could you name one?
  4. Are you aware of the celebrity “nude photo” hacking scandal? If so, could you name any of the celebrities involved?

The responses from these kids are just mind blowing…

So the total results:

  • Six out of 30 students recognized that this week is the anniversary of the September 11 terrorist attacks.
  • Four out of 30 students were able to name one of the American journalists beheaded at the hands of ISIS.
  • 29 out of 30 students were able to identify one or more celebrities involved in the nude photo hacking scandal.

The kid interviewed two minutes in genuinely reacts like he had no idea what had been going on and it clearly upset him, which is great but frustrating. Actually this whole situation is frustrating. How is it that college students in their late teens and early twenties know more about pop culture and the ridiculousness of a nude picture hacking scandal than they do about current events and the death of two Americans at the hands of terrorists? This is not only the responsibility of these young adults to know what’s going on but it is the responsibility of teachers, parents, and our society as a whole.

There are already so many issues with what kids are learning in the classroom today that this should not surprise me, but it honestly does. How is this possible? When I was growing up my parents and grandparents talked to me about Pearl Harbor and the significance of that date. We may have brushed through it in history class but it is a day that I remember because it was an important part of history. My grandparents even lost friends and family members during the attack on Pearl Harbor and World War II. The same could be said about 9/11 and the Iraq War that followed. Hell, there are even movies about the two events. While there have been about seven movies made about the Pearl Harbor attacks, nearly 20 have been produced about 9/11.

What has become of our younger generation? Things need to change or our society will become Idiocracy.

This video is a great representation of what is going on in our culture and it needs to stop. We need our children to be better and smarter and more informed. We are not only disappointing our parents and grandparents, but we are disappointing our country, our culture, the world, and our Founding Fathers! Flabbergasted.

I don’t want to end this post on a note of frustration for our society. Instead I want to share a moving video about the last surviving search and rescue dog who returned to Ground Zero yesterday, a place she had not been to since 2001.

Hey y’all!

The Berkley City Council in California has unanimously approved an ordinance requiring pot dispensaries donate 2 percent of their product to “patients” making under $32,000 a year. A single person is eligible for this “welfare weed” if they make $32,000 or under, but if that person has a family, the family income has to be $46,000 or under. This ordinance will go into effect in August 2015, but I imagine there will be some pushback over the next year about whether this should actually go into effect or not. I mean really, allowing free weed to those already on welfare? We all might as well quit our jobs or take on low-paying jobs and wait for our handouts. This is getting a little bit ridiculous. How many people in Berkley actually need free weed!?!

There are only three licensed dispensaries in the Berkley city limits and one of those dispensaries, House of Compassion, claims they already had:

[A] program in place that allocated a pound of marijuana for giveaway each week. The pound is broken up into 3.5-gram parcels and distributed on Mondays to anyone who can prove that they are on welfare (using an EBT card or other form of proof) and have been certified to use medical marijuana.

So why the need to create an ordinance if one location already has this program and there are only three dispensaries in the city? I don’t feel right about the reasoning behind this ordinance or the idea that marijuana should be free to anyone. And to be honest, I don’t think it should be legalized.

I don’t believe that every medical marijuana cardholder is someone who is genuinely sick or needing it for medicinal purposes. Back in 2011, the top three reasons physicians gave for recommending medical marijuana were “back/spine/neck pain” at 31 percent, “sleep disorders” at 16 percent and “anxiety/depression” at 13 percent. That is a total of 60 percent. SIXTY PERCENT! Now, I understand that many of these patients probably went through a very frustrating period of trial and error with other medical remedies, like pills, and nothing worked. But realistically how many of these “patients” were telling the truth? I understand, for the most part, the benefits of medical marijuana for some, but not everyone that has an ailment. I get the need for medical marijuana for people diagnosed with cancer or HIV/AIDS–those are diseases that can really take a toll on your body. But the “I need pot because I’m depressed” thing doesn’t sit well with me. Anyone can claim they are depressed or anxious or have certain levels of pain when in reality they don’t. Symptoms can be faked and I know people who have done so, which is why I am so cynical about the whole thing.

My biggest issue with the Berkley City Council is that they basically have said that if you need pot and are on welfare you might as well get it for free. They are allowing the lazy to be even lazier.

In Texas, the Texas Senate passed a bill last year that approved drug testing of welfare applicants so I can’t imagine the ideals of the Berkley City Council will breach the Texas boarder anytime soon. Which is great. Legalizing marijuana is probably one of the most reckless things a state can do. I love the fact that the Texas Senate allows for drug testing and if someone fails that drug test three times, no more welfare for them! “Taxpayer money should not be used to subsidize someone’s drug habit,” read a statement made by Texas State Sen. Jane Nelson, (R-Flower Mound.) I could not agree more!

I’ve seen the functioning pothead who will smoke a blunt everyday but still be able to go to work and act like a contributing member of society. I’ve seen the pothead who will sit at home, smoke out of their glass pipe in front of the computer and play mindless video games all day long, contributing nothing to their own lives or to society. I also recently had a friend tell me that she wished her husband would stop smoking pot but she recognizes that if he doesn’t smoke his four or five blunts throughout the day he turns into a completely different person, so she accepts his decision to smoke weed everyday, all day long. Dependence. Addiction. Altered mood. These are things that marijuana does to a person and it isn’t something that we should condone.

Marijuana’s second hand smoke is said to be very dangerous to children and pregnant women. Obviously there isn’t a whole lot of testing that has been done on the subject because of the dangers but there have been a few and the results appear to be compelling. According to studies, just like any other illicit drug, marijuana and secondhand marijuana smoke can cause premature labor, low birth weights and even neurological damage. There are people reckless enough out there that will disregard warnings and expose their loved ones to the second hand effects of marijuana. This short, but very interesting and to the point, article really brings to light what can happen to young children that are exposed to it in the womb or through second hand smoke.

Now I am not a believer in the “marijuana is a gateway drug to other drugs” idea–I think it is completely inaccurate–but I do think that allowing our country to accept an illegal drug like marijuana simply opens the door to other illegal drugs like opiates. At one point opiates were used like Tylenol is today. We should not revert back to the days of not knowing just to appease the drug users of the world; drugs are illegal for a reason. They do more harm than good.

Hey y’all!

This is going to be a fun one!

Some of y’all know a while ago I was writing a personal blog, stumbled across Law Street, and was fired up by one of the contributors, Hannah Winsten. I wrote a rebuttal and the rest is history. I’ve been writing for Law Street for a few months now and have had the greatest pleasure in doing so, the team rocks! But in the back of my mind I always wondered when I would be able to have another encounter with Hannah. I like to think of her as the antithesis of me, she stands for everything that I don’t believe in, but in a good way!

The day has finally come. Ladies and gentlemen, Hannah is back and she has fired me up!

Hannah wrote a piece this week entitled, “LADIES: Vote Republican and You’ll Get the D” and I thought this will be a fun one. Boy was I right! I love how she starts right off with a sarcastic tone, throwing in those traditional pop culture references before pulling out the big words like ‘racist,’ ‘sexist,’ ‘homophobic’ and ‘Republican.’

First, she certainly did get it right that President Obama is getting close to being a lame duck, actually at this point he’s checked out and moved on to retirement on the golf course while still in the White House. Things haven’t gone the way he planned and homeboy has chunked deuce on the country, as pointed out by fellow Law Street writer Katherine Fabian here.

Who isn’t ready for the 2016 elections? I know I am!

Here we go again with Hannah only selecting bits and pieces of a report, only outlining what is beneficial and relevant to how she thinks and not the whole story. Yes, Politico reported a survey that states 49 percent of single women hold a negative view of the Republican Party, but it also says that 39 percent view Democrats unfavorably. If you go deeper into the article you also see that 48 percent of married women prefer a Republican to a Democrat. It isn’t a very positive article for Republicans but at least it is the truth and they are trying to do something about it.

Yes, the Republican Party has been perceived as the “good ole boys” party and women were neglected in some respects. But there are still plenty of Republican women in the country and I’m sorry but the idea that Republicans support rape and domestic violence is just vile. Does Hannah see all Republicans as toothless, alcoholic, wife-beating-if-they-step-out-of-the-kitchen inbreds? Referring to conservatives as ‘conserva-turds’ is almost as ridiculous as your girl, DNC Chairwoman Debbie Wasserman Schultz, making the comment that “What Republican tea party extremists like Scott Walker are doing is they are grabbing us by the hair and pulling us back.” Maybe you and Debbie get together in the last few days and brainstormed creative ways of calling the Republican Party abusive? Even people in the Democratic Party are distancing themselves from that foolish woman and her hideous remarks.

Nowhere in any Republican initiative or in that specific poll does it say that Republicans are planning to tell anyone that they are wrong. Nowhere. The report says that it is a “lack of understanding” between women and Republicans that “closes many minds to Republican policy solutions.” But let’s be honest, we don’t need a poll to tell us that there is a lack of understanding between the American people and politics. Not many in my generation or in younger generations take the time to understand politics, they just go with what they hear on television and we both know that is not an accurate depiction of politics at its core.

Hannah claims that Republicans will basically shake their fingers at all women, tell them they are wrong, and expect them to go out and vote for the GOP. What exactly are you reading that says any of that? Oh right, it is all based on opinion, not fact. Let’s go back to the Politico article where it states that the group that took the poll suggests “Republicans deal honestly with any disagreement on abortion, and then move to other issues.” Again, the report suggests this for Republicans. On the upside, there have been several Republicans who have come out in support of over-the-counter birth control, and many conservatives in general are Pro-Choice. Yes, Republicans should deal with the abortion topic with real facts, solutions, ideas, and then move on. Unlike Democrats who are still ignoring the facts of the IRS scandal, the Benghazi issue, ISIS, and most importantly Obamacare.

R.R. Reno made valid points in his opinion piece on the dilemma facing social conservatives, but my dear Hannah took what she wanted and neglected the rest. She assumes that this piece is to attack single women, assuming that they live with 12 cats and are terrified that they will end up alone so they recognize the strengths of getting a hand out when they are older and thus support the Democratic Party. What Reno was doing was quoting a statistic about marriage and vulnerability and then putting his two cents in on why McKinsey, a fictional character, may feel judged when someone “opposes gay marriage, because she intuitively senses that being pro-traditional marriage involves asserting male-female marriage as the norm — and therefore that her life isn’t on the right path.”

That is a valid argument and a valid way of thinking. I know that I was raised to believe that the order of life is to graduate high school, go to college, get a job, get married and have kids all under the age of 30. Guess what? I’m 29, I have two degrees (working on a third), and two jobs, but I am not married or have kids and it is a scary idea sometimes. Our parents’ traditional ways were engraved in our minds as young children, but the path our parents and older generations took is not what our generation wants to take. It will take time, but not everyone feels supported in their ventures because we aren’t doing what we were “supposed” to do. I’m glad I messed up and took a different path. I’m a better person for it. Reno was simply putting those ideals in a simple statement and showing that McKinsey chose to reject the norm so that she could feel accepted in her choices, and nothing is wrong with that.

I hate to break it to you, Hannah, but if you think women are voting Democrat because they “want to have control over their own bodies, their own reproductive systems, and their own lives. They want to be able to support ourselves. They want to lead lives that aren’t wracked with violence,” then you should probably vote for the unrepresented party. Democrats are taking away more of your rights than Republicans. Remember that tiny thing called Obamacare? Yeah, do some research and you will find there are more restrictions than advantages. You want to live your own life without someone dictating what you can and can’t do? Should probably take another look at the Democratic Party and its belief in big government, controlling every aspect of our lives and making people believe that they are entitled to handouts instead of working hard for what they have in life. Democrats would rather rich people do the work and hand the benefits to the less fortunate and lazy. Democrats believe in helping everyone but also in accruing more debt — that doesn’t help the economy, it hurts it.

At least Republicans are trying to fix their issues, listen to the people, and change (slowly) with the times more so than Democrats. Not to mention they are taking responsibility for their errors.

If you think Hillary is going to be in the White House in 2016 you’ve got another thing coming. The same “what difference does it make?” Hillary who was so flustered and frustrated about being questioned on the topic of Benghazi that she lost her cool? The same Hillary Clinton who admitted to leaving the White House with her husband President Bill Clinton, personally $10 million in debt? I’m not sure that is someone I would want in the oval office. Let’s be truly honest. We all know that while President Clinton was busy getting blow jobs in the Oval Office Hillary was really running the country. So she’s been president, just behind the scenes, and we don’t need her again.

I’ve said this before, everyone is entitled to their own opinion but the moment that opinion turns into something disrespectful I have an issue with it. The holier than thou, self-righteous, talking down to anyone who doesn’t agree with you tone is not cool. I enjoy Hannah’s quick wit and sarcasm but sometimes she crosses the line. Republicans are people too and in most cases highly educated people who just don’t share your views. Ease up on the conservative detest because you are simply putting yourself in the category of abuse that you talk so much about hating.

Hey y’all!

Just the other day I was standing in line at local grocery store, waiting patiently for the people in front of me to finish purchasing their groceries, when I glanced over to the magazine rack and was startled by the image on one of the covers. People Magazine is best known for its celebrity trash, something I’ve outgrown for the most part, but the cover was something I would never have expected. It was a full on, black-and-white picture that took up most of the space and the face looked so familiar but I couldn’t remember who it was until I saw the tagline: “Chilling New Details, Murdered By Manson.” The black-and-white photograph was of a beautiful Sharon Tate,and it turns out this is the 45-year anniversary of the slayings. Sadly, on the left side of her gorgeous picture was a hideous picture of Charles Manson and to the right the usual celebrity gossip photos. Way to bring tragedy and gossip together, People!

Most of us are too young to recall or even know about the Manson Family murders, but it was a subject that had always intrigued me since I saw an interview with Charles Manson and Barbara Walters in the early 90s.

For those of you who aren’t familiar with these iconic slayings, here is a quick run down of the events. On August 8 and 9, 1969 at the command of Charles Manson, a small group of his followers brutally murder five people at the Benedict Canyon home of director Roman Polanski. The victims were actress Sharon Tate (Polanski’s pregnant wife), coffee heiress Abigail Folger, celebrity hairstylist Jay Sebring, writer Wojciech Frykowski, and Steven Parent, who was a friend of the family’s gardener. These murders were committed by Manson followers Tex Watson, Susan Atkins, and Patricia Krenwinkel, with Linda Kasabian accompanying them as lookout. Unsatisfied with the murders, Manson and his group — this time including Leslie van Houten and Steve “Clem” Grogan — went out in search of more victims. On August 9 and 10, 1969, the group murdered supermarket executive Leno LaBianca and his wife, Rosemary.

Eventually all of the murderers were caught and convicted. In 1971 Manson, Krenwinkel, Atkins, and Van Houten received the death penalty, and Charles “Tex” Watson was found guilty of the murders of seven people and sentenced to death. In 1972, the state of California abolished the death penalty and all sentences were converted to life imprisonment; however, the state reestablished the death penalty five years later, only reverting 68 of the original 107 sentences back to the death penalty.
The Manson Family murderers were not among those whose sentences were reverted to the death penalty, and they have all been eligible for parole at some point. April 12, 2012 marked the twelfth time Charles Manson was up for parole, as well as the twelfth time it was denied. Just last month one of his associates, Bruce Davis, who murdered the owner of the ranch the Manson Family was living on as well as a stuntman, was denied parole by the Governor of California despite his third recommendation for release by the parole board.

It’s a scary thought that these people are still alive and going through the processes of even being considered for release on parole and it bothers me. I am a true Texan, I believe in the death penalty. Sometimes it’s a joke how much Texans love our death penalty, but I think that sometimes the world needs to be rid of evil. Manson is the epitome of evil. I have to wonder what California was thinking when it selected those 68 people to be put back on death row in 1977 and decided to exclude Manson and his followers? Wouldn’t the most heinous of people be at the top of your list?

Forty-five years ago people lived in fear because of the Manson Family, but most of us seem to have either forgotten about it or never knew about it in the first place. Every now and then some news outlet has to remind us all of a moment in time that knocked the socks off of the entire country. When I picked up the People Magazine to read the startling new details of this 45-year-old case I was curious to see what new information had been brought to light. Unsurprisingly, People lied. There was no new information, it was a puff piece in which someone interviewed Sharon Tate’s sister and she gave her recollection of that day and then promoted a new book that is all photographs of the late actress.

I may be disappointed about the article in People and will not encourage anyone to waste five dollars buying it, but it is an interesting way to remind everyone that there are horrible people out there in the world doing unthinkable things to innocent people.

Hey y’all!

We’ve all seen the news coverage about the Michael Brown shooting in Ferguson, Missouri. Not just the shooting, but also the aftermath that has turned a tiny town into a rioting disaster. Just in case you didn’t hear, Michael Brown was a young black man who was shot several times and killed on August 9 by a white police officer. But did you hear about the young man in Utah who was also shot and killed by a police officer? No? I’m not surprised. Twenty-year-old Dillon Taylor was shot to death by a black police officer two days after Michael Brown.

Where is the outcry filled with blinding rage in Utah that has filled the streets of Ferguson? Why have there been no reports of Dillon Taylor’s death, except a few small pieces found here and there on random news sites? No mention on CNN, MSNBC, or any well known 24-hour news station.

Dillon Taylor, described as white and Hispanic, was shot right outside of a 7-11 on August 11 by a black police officer. I hate to quote Rush Limbaugh because I’m not a huge fan of his, but he said it best on his radio show: “In the current climate in the United States, a black person can never be the oppressor, and a white person can never be a victim.” Truer words have never been spoken. I realize that history has shown that white people oppressed blacks and other races. But the same has happened to whites, obviously not in the same way and not as widely remembered, but everyone has been oppressed in some way at some point in history. Why is the life of this young black man more important the life of a young white and Hispanic man?

The biggest point I want to make is that both of these young men should have the same amount of coverage, but they don’t and it is all based on race double standards. If you take a step back and look at the context of both of these shootings you would realize that there is no real difference except the color of their skin and that of the police officers. When will people stop and think about the bigger picture, not everything should be about color. It is about right and wrong. And for that matter we don’t even know who is right and wrong until all of the facts are released and the police officers who did the shootings have been investigated.

Hey y’all!

As most of you know, I hail from the great state of Texas! I wasn’t born here but my parents made sure I got here as fast as possible. I’ve been here long enough to experience both governors George W. Bush and Rick Perry, two men I have a great amount of respect for.

I was flabbergasted the moment I read that Governor Rick Perry is being indicted for alleged abuse of power in a veto dispute. First, I must have been hiding under a rock for a few weeks because I had no idea that they were even considering indicting Governor Perry. But let’s be really honest, someone is always trying to sue or indict a lawmaker, even the President. We do live in a world of frivolous lawsuits so I really shouldn’t be surprised.

Let’s jump in to the most ridiculous of the ridiculous: The person who made the decision to convene a grand jury to indict Governor Perry is Travis County District Attorney Rosemary Lehmberg. The same woman who was arrested for drunk driving. No one is above the law, but she clearly thought she was. The cops even had to put a spit guard on her and strap her to a chair. What does that say about her decisionmaking skills? I find her almost as laughable as the crack-smoking Toronto Mayor.

To make things even worse, after Lehmberg plead guilty to drunk driving, she refused to leave her position as District Attorney. How shocking, one poor choice on top of another. It puts the whole Perry indictment into question. Actually, for me it makes me question her whole career. Forget her political affiliation, consider the decisions she has made and think, how that one decision ruined her life, and think about how many other decisions that she has made that have had the same impact on others. You have to question her ability to reason — or at least I do.

An indictment would kill a presidential bid for most political careers of this magnitude, but it seems to be making Perry’s stronger. So many people have come out in support of him it is like a blessing of endorsements for the future run.

Part of what Perry is being indicted for is “misusing government property, services, personnel, or any other thing of value belonging to the government that has come into the public servant’s custody or possession by virtue of the public servant’s office or employment.” Perry threatened to veto funding for the state’s public integrity unit last summer. This veto threat is more specifically about $7.5 million in funding for the state’s public integrity unit, the ethics watchdog unit housed under Travis County District Attorney Rosemary Lehmberg’s office.

I think that this whole thing is a game of cat and mouse. It also seems to me that today’s government officials are more stubborn and selfish than ever. What about that is good for the people? Rosemary Lehmberg is a joke and has turned the Travis County District Office into a joke as well. Governor Perry may not be perfect but at least he knows how to conduct himself in a manner that doesn’t lead to a spit mask, being arrested, putting people’s lives at risk, and being strapped to a chair.

It was heartwarming to read that Governor Jack Markell (D) signed Senate Bill 245 into law last week. This new law will allow seized dogs from fighting situations, mostly Pit Bulls, to be individually evaluated to see if they have a chance at being adoptable pets. Before Senate Bill 245 was enacted all dogs that were seized from fighting situations were deemed dangerous and immediately euthanized, including puppies and pregnant females.

Just last week a fellow Law Streeter, Ashley Shaw, wrote a really great piece about animal rights in our judicial system. It was fun and informative so you all should definitely go check it out! Just a few days ago I came across an article about abused pit bulls in Delaware getting second chance thanks to a recent law signed by Governor Jack Markell.

I am a serious animal lover. I have four dogs and a fifth has stolen my heart (the boyfriend’s dog). One of my four dogs is a Pit Bull and Border Collie mix named Melou. She is a happy-go-lucky dog that likes to play in the yard and bark at everything that walks past our house. She can also be very territorial but in a good way, just like any other dog she is protecting her home. She has the aggressiveness of a Pit Bull and the herding skills of a Border Collie. Though she may have the not-so-great characteristics of both breeds, she also has a mixture of the great things. She is extremely playful and loving, and she can be overly aggressive when it comes to play time with other larger dogs, but it’s just because she loves to play. I have a friend who has a Pit Bull and Weimaraner mix, Dexter, that is massive and several years younger than Melou but they play well together.

It is unfair to classify all Pit Bulls as scary, aggressive dogs. Did you know it is actually illegal to own a Pit Bull in Miami-Dade County? Miami-Dade can actually fine the owner and forcibly remove the dog from his home. How unfair is that? I understand that Pit Bulls have a reputation of being overly aggressive and all-around scary, but anyone who has ever encountered or owned a Pit Bull knows that it is simply not universally true. Yes, these dogs can be trained to kill one another and to attack anyone but so can any other dog. Mind you it would be hard for a Chihuahua to kill a person because of how tiny it is, but any dog can be trained to do harm. It all depends on how it is raised.

Pit Bulls are very loyal, friendly, and full of energy — the best kind of family dog to have! Melou is sweeter to people who come over to my house than my little Chihuahua who gets overly aggressive, barks, and growls at everyone except certain family members.

There are only 13 states left that still support euthanizing all fighting dogs without really taking a look at them. The state of Michigan recently introduced Senate Bill 990, which calls for a change similar to the one made in Delaware. Even in 2011 the American Bar Association called for legislative and governmental bodies to “ensure the humane treatment and disposition of seized dogs.”

Thanks to Michael Vick and his pals, the American people were able to get a better understanding of the horrific side of dog fighting and take a stand against something so heinous. Vick’s situation also opened the door of rehabilitating used and abused dogs, which showed the world that even damaged Pit Bulls can become loving animals.

Hey y’all!

I like to keep an open mind about our government and how different states run differently, but there are some things that I feel like would make more sense if every state did them the same way. Maine’s Governor, Paul LePage (R), has reinstated a policy that would make people have to work for food stamps. No more sitting around on your ass waiting for that welfare check to come in, nope, you have to actually work for the money.

“People who are in need deserve a hand up, but we should not be giving able-bodied individuals a handout,” LePage said in a statement. “We must continue to do all that we can to eliminate generational poverty and get people back to work. We must protect our limited resources for those who are truly in need and who are doing all they can to be self-sufficient.”

I think that this is one of the greatest ideas ever, but I also wonder why they have to reinstate such an idea, and why aren’t other states doing the same thing? Wasn’t the original idea of food stamps and welfare just to help people who are down on their luck and trying to find a job? When did we allow welfare to become a way of life? In fact, when did we start allowing people on welfare to become lazy and just accept a handout without having to work for it? I can’t say  that I remember a time when everyone understood the value of a dollar and what a good work ethic is because I’ve never lived in a time where that held true, but I know that at one point in this country our citizens knew what they had to do in order to get by. Nowadays you can pop out a couple of kids, get on welfare, and just sit around waiting for that money to be deposited in your account. You don’t have to actively look for a job, volunteer, or commit to attend a workforce program. You can just say you need the money and the government will hand it on over, the more kids you have the more money you get.

I am no stranger to the ways in which some people have found to manipulate the system. I’ve heard stories of people who will get on food stamps or welfare, take the government’s money, and buy themselves a brand new iPhone or a new pair of Jordans or any other material thing that you don’t need when you are living off of welfare. Do you know where that “government money” is coming from? That money is coming from my pocket. That money is coming from the guy who works a 50-hour work week on minimum wage trying to make ends meet because he understands what hard work and supporting his family are really all about.

Do people not realize that when it comes from the government it’s actually coming from the people!? That’s why we pay taxes, so our government can supplement the many things that we need as a nation, and part of that goes to supporting those who are on welfare. If you are an able-bodied person who can work and is on welfare then there should be a stipulation that says you have to be doing something rather than sitting at home watching Real Housewives of New Jersey or hanging out with your friends. Why not volunteer or participate in a skills training program? Be an active member of society, be a part of your community in a positive way, and teach your kids that a handout is something to be ashamed of. Teach your kids good work ethic and respect for our government.

Under Maine’s new policy people capable of working would be limited to three months of food stamp benefits over a three-year period unless they work a minimum of 20 hours a week, volunteer a certain number of hours for a community agency, or participate in a state skills-training program. This was the point of welfare: to help you out until you can get back on your feet and support yourself and your own family again. Reinstating this policy is something that all states should think about doing (if they aren’t already)!

Way to go Governor LePage and good luck to the people of Maine!

Hey y’all!

I was just doing my normal internet surfing, riding the news wave and trying to find something that hasn’t bombarded your TV or social media outlets yet. What I stumbled upon is so ridiculous and infuriating I just could not let it go.

So, the University of Wisconsin – Madison has come up with a new policy that states good grades should be distributed equally among different races. Known as the “Framework for Diversity and Inclusive Excellence,” this policy calls for “proportional participation of historically underrepresented racial-ethnic groups at all levels of an institution, including high status special programs, high-demand majors, and in the distribution of grades.”

I’m sorry, WHAT!?! Obviously colleges like the idea of diversity — they promote it every chance they get — but if you go back and actually read what the policy calls for then you’ll see that while they may be promoting diversity, they are also promoting racial oppression. “Historically underrepresented racial-ethnic groups” — it is stated right there. In most cases white people have not been historically underrepresented. So what UW-Madison is saying is let’s give out free grades to students who are not white and who may not have worked as hard as other students. What about those students who are “historically underrepresented” who work their asses off to get those good grades? Why should they have to work so hard for their grades but their peers simply get handed the same grade because of their race or ethnicity?

By all means please promote diversity at a university, it is one of the best ways for people to learn from one another. But handing out grades based on race is a slap in the face to every student and professor at any university.

W. Lee Hansen, professor of economics at UW-Madison, was outraged by this policy and shared his opinion. “Suppose there were a surge of interest in a high demand field such as computer science. Under the ‘equity’ policy, it seems that some of those who want to study this field would be told that they’ll have to choose another major because computer science already has “enough” students from their ‘difference’ group.” Professor Hansen goes on to say, “Especially shocking is the language about “equity” in the distribution of grades. Professors, instead of just awarding the grade that each student earns, would apparently have to adjust them so that academically weaker, ‘historically underrepresented racial/ethnic’ students perform at the same level and receive the same grades as academically stronger students.”

How would any professor or student be okay with even the idea of this policy? How did UW-Madison get away with putting this policy into effect! Each student had to work hard to get into the university but now all of a sudden the school is saying that no matter what you did in the past if you are considered “historically underrepresented” you can simply show up to class and still get a good grade.

What’s the point of going to college if this is how it is going to be? These kids are going to end up with a four-year degree that they did not earn but simply purchased. If that’s the case why not just close down all institutions and require people to write a check for $80,000 – $125,000 to the government and have them hand out degrees.

Instead of promoting hard work, dedication, and real education, UW-Madison has basically said, “Come to UW-Madison where you pay tuition and we will give you the grades.” Is this really the kind of reputation that a university wants to have? Is this the kind of reputation that any student graduating from this institution wants to have? I know if I were ever in a situation where I was going to hire someone I would never want to hire the graduate from UW-Madison because he may not have understood the purpose of college and may not have learned anything except that things can apparently just be handed to you.

Life does not work that way. Life is not easy or fair and part of that statement includes the idea that school is not easy. You get the grade you worked for, not the grade that was assigned to you because of your race.

Too many of today’s youth are just expecting a hand out. They aren’t being taught the value of a dollar or a strong work ethic. Here comes the reference again, Idiocracy at its finest.

I also find it very interesting how hard generations before us fought for equality but here we are creating more separation than ever before. Is it not obvious to the world that subtle lines are being drawn in the sand? No one is created equal anymore. We might as well throw out the Declaration of Independence and forget about our past because nothing has really changed. People talk about how racism and sexism are still very alive in our world and how things need to change for the better. But how can anything change when universities are promoting policies that demonstrate separation over equality? Equality is not being promoted in this “Framework for Diversity and Inclusive Excellence” policy at all.

You want to be equal? Take the same classes as your peers, work as hard as you can and get the grade you deserve. That makes you equal with your peers, not waiting around for a professor to give you an A for a class that you probably barely attended, never studied for and possibly slept through.

Shame on you University of Wisconsin – Madison for not only promoting racial and ethnic oppression but for also basically telling your students that they aren’t smart enough to get the grades on their own. Not to mention telling the world that handing out grades because of race or ethnicity is okay, thanks for basically showing the world that the fight for desegregation in all aspects meant nothing. I’m sure Medgar Evers, Betty Friedan, Susan B. Anthony and Martin Luther King, Jr. are all turning in their graves.

Immigration issues won’t be fixed overnight, but having a president who blatantly and publicly makes fun of the issue is not a step in the right direction and is actually a huge step back. If the President of the United States doesn’t really care about the issue then why should anyone else care about it? His job is to not only lead us but to represent us in the global arena, and when he shows weakness and disdain for his own people that shows the world that they can have the same lack of respect for our country and our citizens.

Hey y’all!

Last week I wrote about President Obama coming to visit Texas and the issues I have with him and Houston’s independent school district. I thought I would be able to say my peace and move on. Unfortunately that is not the case. As the week went on there was more and more talk about immigration and I feel like it is time for me to say a little bit more.

First of all, it was great to see that President Obama got off of his high horse for a little while to even speak with Governor Perry, but it did not seem like it was taken too seriously. I’m sure you’ve all seen the photo of Obama and Perry sitting at a table together: Obama is laughing away and in a jolly good mood whereas Perry has a sour look on his face. There have been jokes and comments made about Perry being too serious and Obama trying to defuse the situation. No one knows what was actually going on in that room when the picture was taken but I think that it is fair to say that the look on Perry’s face is one of frustration. In this state immigration is a real issue. It can be talked about over and over and over again in DC, but the realities don’t hit as hard as they do here.

I can appreciate that Obama agreed with some of the points that Perry made, but then he had to go and make a stupid comment. In a speech after the meeting he stated, “You know, they said we needed to triple the Border Patrol. Or now they’re going to say we need to quadruple the Border Patrol. Or they’ll want a higher fence. Maybe they’ll need a moat. Maybe they want alligators in the moat. They’ll never be satisfied. And I understand that. That’s politics.”

So where is the problem? The problem for me is this entire statement. He basically just laughed off the entire situation in a matter of seconds. Not to mention he made himself look like an idiot by stating we would want a moat. Dear Mr. President, please take out your third grade geography book and notice that there is a RIVER that separates a good portion of Texas from Mexico, that little thing called the Rio Grande. Details. Yes, I know he was making a joke and being overly dramatic but let’s get something straight: this is not a joking matter. For him to come out and make jokes about a serious issue in our country is disrespectful and shows how little he cares about the domestic issues.

In the last day or so there have been reports that 40 illegal immigrants were returned to their homes in Honduras, including adults and children. Forty immigrants, and government officials are claiming that is “a step in the right direction.” Excuse me? Forty immigrants is a step in the right direction? Among the estimated 82,000 who are still sitting in federal housing, they chose to send back 40. That is a laughable number. The average Boeing 747 airplane can seat 416 passengers.  That is 376 empty seats on a plane for those 40 people to stretch out across. I know that there is a method to what needs to be done before sending these people back to their countries but maybe processing more than 40 at a time would help the situation.

Immigration issues won’t be fixed overnight, I realize that. But having a president who blatantly and publicly makes fun of the issue is not a step in the right direction and is actually a huge step back. If the President of the United States doesn’t really care about the issue then why should anyone else care about it? His job is to not only lead us but to represent us in the global arena, and when he shows weakness and disdain for his own people that shows the world that they can have the same lack of respect for our country and our citizens.

Hey y’all!

President Obama will be coming to Texas today. Yippee! Thankfully he doesn’t plan to come to Houston so I don’t have to worry about the traffic jam disasters he tends to create. We Houstonians have to deal with horrible traffic day in and day out so having that additional stress just makes us less friendly.

Let’s get to the more important stuff: President Obama, Governor Rick Perry, and immigration. So much has come out about these three in the last couple of days that it is making me mad.

But first I want to address the petty topic that Governor Perry has declined shaking President Obama’s hand when he hits the mean Texas tarmac. When I first read this headline I thought, “Oh great, something else for Democrats to grab on to and slander Texas and Republicans with,” but once I read the blurb that went along with that headline it actually makes sense. I love Governor Perry and although I don’t agree with him on everything, I do agree with him on not wanting to simply shake Obama’s hand and take a few pictures. Despite our differences you should always show respect to our Commander in Chief (until Texas secedes from the Union — though we all know that isn’t legal or likely). But if our good ol’ President is going to come to Texas he should probably squeeze in a little time to talk to the Governor and see what’s going on at the border instead of hitting up Democratic party circuit. Squeeze in reality for a few hours sir, you might look like you care about what’s happening down here.

Moving on to something a bit closer to home and a little more important: a Houston Independent School District (HISD) middle school is being considered as housing for immigrant children. I am the product of a HISD education — a craptastic one at that — and my intelligence and creativity come from hard work and influences outside of the HISD realm, but I still feel it is necessary to share that tiny bit of information. HISD is the largest school district in Texas, seventh largest in the United States, and it has 282 schools. Yes nearly three hundred schools, but how many of those are actually in use?

HISD was so kind as to give Homeland Security officials a nice little tour of an abandoned middle school in the Houston area. Why would Homeland Security want to come visit an abandoned school, you ask? Well it’s because this building is being considered for housing for undocumented children who have crossed the Texas-Mexico border in recent months. Most of these kids crossed the border illegally and alone, which has now turned into another issue that the U.S. is being forced to handle. Typically Border Patrol is required to transfer all unaccompanied children over to the federal Office of Refugee Resettlement within 72 hours, but because so many children — 52,000 since October 2013 — have crossed the border it is taking more time and resources to house all of these illegal children. Surprisingly by law, all illegal alien children who are not from Mexico cannot be immediately deported without an additional investigation to ensure that these children are not victims of sex trafficking.

It was news to me to find out that Terrell Middle School, the site of the tour, had been closed since 2001 and is now simply a storage unit for the district. So instead of taking the hard-earned tax dollars of Houston locals and putting them into keeping Terrell as a school, people like Congresswoman Sheila Jackson Lee and the higher ups within HISD feel it is okay to turn it into a housing facility for children. I have never been a fan of Congresswoman Lee and certainly have very little respect for anyone at HISD, but this is getting a little bit ridiculous. Allowing an abandoned school to go unused is infuriating, but then to turn it into federal housing is even worse. Yes, these children need a place to stay but it is not the responsibility of a school district to house children and the federal government should probably get its act together and do what needs to be done. Terrell could be reopened had HISD used a little bit of a $1.9 BILLION bond to update it instead of just letting it sit there while they tear down and rebuild schools that really don’t need to be renovated or rebuilt altogether.

What else could the abandoned middle school be used for instead of just housing for immigrant children and storage for HISD? Well, the school could be torn down and the property sold to a private investor to create more housing or a shopping center for the area. Or even use the land as a sports arena. At the end of my neighborhood is a parcel of HISD property that is all baseball fields rented out to a local little league association for $1 a year. HISD doesn’t even care to profit from what it already owns. The building could be turned into a public library, police station, or even a community center. Allowing the 14.5 acres to be used in a way that is beneficial to the city of Houston is much more ideal than allowing it to be turned into storage or federal housing for undocumented children.

Everyone knows that getting anything done by the government is like watching paint dry. Slow and painful. And can I ask why President Obama declared back in June that we have an “urgent humanitarian situation” at our border? This is not something new; this has been going on for decades. Sometimes I wonder where the President has been all of these years. I’ve seen the statistics: there have been a larger number of border crossings in the last year but there is a reason for that. I partially blame how bad it is getting south of the border, but I also blame how relaxed we have become about our borders without even realizing it.

I may come across a bit heartless, but I don’t believe in a handout and I don’t believe that just because you cross the border into the United States that you are automatically allowed to live here, even if you are a child. There are laws and regulations that need to be upheld. The first step to becoming an American is to respect the United States.

Hey y’all!

Just the other day I was catching up on the happenings around the world and stumbled upon an article that has really annoyed me. Robert Morris University in Chicago is planning to offer athletic scholarships to kids who play video games. Not just five or six scholarships, but 30. Yep, 30 scholarships for kids who play video games; more specifically, one called ‘League of Legends’.

I will be perfectly honest, I don’t know much about video games. My experience was playing the duck hunting game on Nintendo 20 years ago and the occasional Mortal Kombat stint. I know a lot of the lingo and various games because of my brother who still likes to play occasionally when he has free time from, you know, being an adult; but I have never heard of ‘League of Legends’ and had to call upon both my brother and Google to set me straight.

So apparently ‘League of Legends’ is a mixture of RTS (real-time strategy) and RPG (role-playing game). These are both things that I vaguely understand but it seems to me like a group of kids get together around the world, team up, and try to conquer the game. So how exactly is this athletic related? It isn’t and that’s where this makes my blood boil.

I do think that this particular game requires a certain level of strategy but that does not make it athletic, which is defined as “sports, games, and exercises that require strength and skill.” Strength and skill. Where in the world does a video game require either one of those things? Lifting up and holding a controller while sitting on your ass does not require much strength, not to mention the level of skill required on a video game doesn’t seem to be all that much. Yes, you need to be able to understand the rules of the game and the role you are playing and how to win, but does that really require much skill?

Now, let’s look at this from a less self-involved perspective. Robert Morris University is a Division I school in the NCAA so obviously athletic scholarships from this school are tied to that organization. The NCAA website has absolutely no information on requirements for a video game athletem and honestly there really isn’t a true definition of a general athlete there either. The only requirements are certain core classes have to be taken, a decent GPA, and maintaining amateur status throughout school.

Are there professional gamers? I mean legally, real professional gamers? Not just 30-yearold guys sitting around playing video games in their parents’ basements. Does the NCAA even embrace this idea? From all accounts on its website it doesn’t seem to me like it is something that the NCAA would embrace willingly or very quickly. They even have a specific section dedicated to the value of college sports, including college education, academic success, scholarships, student assistance, academic and support services, medical care, elite training opportunities, healthy living, exposure and experiences, and preparation for life. Some of these are no brainers that every student should get from attending college, but others are specific and special to being a college athlete, things that I don’t think apply to the world of gamers.

Elite training opportunities…training for what in video games? Healthy living…so no more soda and chips as you level up? Exposure and experiences…sitting in front of a screen next to someone else not being exposed to anything even if you are in a different city competing for some video game competition? Medical care…for carpal tunnel and the occasional blister? Preparation for life…I don’t see how ‘League of Legends’ would prepare anyone for life outside of the technology world.

As I get older I get more and more annoyed by the fact that younger generations would rather sit inside and watch TV or play video games than go outside and play tag or ride a bicycle. When I was a kid my summer days were filled with sunburns, swimming pools, neighborhood kids, and adventures that took me outside of my house and sometimes out of my own comfort zone. Now I don’t see kids playing in the streets with other neighborhood kids. They don’t even go up to the seemingly abandoned neighborhood pool. Technology is taking over everything, creating anti-social lazy kids and colleges are now going to promote it?

Way to go Robert Morris University, you have taken us one step closer to allowing video games to be considered a sport and to the ideals of Idiocracy.

Hey y’all!

Unlike most of the world I don’t start my day off with a morning cup of Joe. I tend to just jump right into whatever I have going for the day minus the caffeine jolt. I know, it’s a little weird. But all of you who survive your days because of a great cup of coffee should take into consideration that, most likely, that cup of coffee you are drinking is from one of the greatest companies in the United States.

I’ve had my love affair with a venti White Chocolate Mocha with an extra shot of espresso, but too many of those and a massive anxiety attack will cause anyone to stop with the coffee for a while. Starbucks makes a mean cup of coffee and you can have it any way you want it, that’s the point of their existence. Until now. I was intrigued the other day when I heard the announcement that Starbucks would be paying for any employee who works 20 hours or more to go back to school. It was even more interesting to discover that it would be online and at Arizona State University. I find it odd that there is a specific school that Starbucks has teamed up with in order to get their employees a higher education. Why Arizona State? Isn’t Starbucks a Seattle-based company? Wouldn’t they want to promote a Washington state school? These are all valid questions but then I realized, why am I asking such silly questions. I just graduated from Arizona State with my Master’s.

Arizona State is a great school, the curriculum is sharp and to the point. Not to mention I had the greatest experience with the professors. Most college professors are extremely liberal and I did have a few moments of uneasiness when things were said about the Republican Party or conservatives in general but I was allowed to voice my opinion and it was well received. So of course Starbucks would want to pick Arizona State and the online program has such an extensive selection that you could pretty much become a doctor or lawyer through their online program.

Although I have personal reasons for thinking this is a great idea, I wonder how many other people would agree. I mean there are those who may not like the idea of an online education or attending Arizona State, but I feel like this is a great partnership between Starbucks and ASU. I don’t think, though, that Starbucks is taking into account what their employees might want out of their own education. Some may not feel comfortable with the online method of learning or they may learn better in a classroom. Though an online education is just as good as being in a classroom, some just don’t do well with it. There is a certain kind of person who can succeed with the online program and that is usually someone who is very dedicated and organized. Online classes are in no way easier then classroom courses; in some instances they are even harder. With that being said it is a great step in the right direction for a company to promote education and to want to help their employees become better in their own personal lives.

All in all I say kudos to Starbucks and Fear the Fork!

Hey y’all!

Like it or not we live in a social media world — it is sometimes shoved down our throats when we don’t want it to be. No matter what show I watch, especially the news, everyone has a Facebook, Twitter, Instagram, YouTube, Vine, or Pinterest logo popping up on the screen attached to the handle of whomever is speaking at that moment. Don’t get me wrong, I love social media, but I wonder how far we have allowed this phenomenon to take us that soon-to-be married couples are considering Social Media Prenups.

I tend to be a fairly private person and I don’t post every move I make on Facebook. My Twitter, on the other hand, is an outlet for everything that is going on, but I try to keep it as anonymous as possible for others involved. With that said, there are plenty of people out there who put their entire lives on Facebook and Instagram. I think it’s great if you are one of those people, you are braver than I am. But where do you draw the line?

I always thought a prenuptial agreement was something that was drawn up for a couple on the incase that the marriage might go south and the individuals need to protect themselves during the fallout. When did dictating what a person can or cannot do during the marriage based on social media become a thing? Why would you marry someone who did not respect your verbal wishes of keeping certain things private and between each other and not put it out for the whole world to see? This concept of a social media prenup screams a lack of respect for one another’s privacy and wishes, so maybe you shouldn’t marry that person if he can’t do the simplest of things. Not to mention that respect should be a deal breaker. If you don’t respect the other person then why are you with them?

I love social media, but this is getting out of hand. Penalizing your spouse for posting a picture, really!?! That’s unnecessary drama just waiting to happen. I do understand that if the marriage ends and your now-ex decides to post awful pictures and sexual videos or slander your name, you have every right to penalize them and that should be something included in a prenup — or even just a simple contract for married couples. But just because your husband posts a picture of you that you think doesn’t look good should not warrant a fee. Simply ask him to take the photo down! And if he refuses, y’all have bigger issues than a bad photo on the internet.

According to ABC News, people are also creating “love contracts,” which are essentially something that promotes a way of communicating and understanding one another’s boundaries. I think it’s a good idea but attaching a financial penalty to posting a bad photo is just insane, petty, and childish. Laying out a plan and understanding ways of better communication should be something every couple does before getting married.

Go out and enjoy life. Share it on Facebook, Instagram, Twitter, YouTube, or Vine. Just don’t cross a line that you know would upset your significant other. Respect your relationship and respect social media.

Hey y’all!

Greetings from Las Vegas! As I mentioned last week, last week was my birthday so I decided to celebrate it the right way and am spending a few days in Vegas with friends. It’s been a blast so far!

I am a creature of habit and no matter how late I stay up my body and mind are still ready to get the day started at 9am despite any time zone. Part of my morning ritual is to watch Fox News just to see what’s going on in the world. Monday morning I stuck with my routine, flipped on the television and watched whatever program was being aired. In this case it was the afternoon (on the East Coast) show, Outnumbered. This show has a rotating group of hosts but the only consistent thing is that there are four women and a man sitting on a couch talking about topics of the day and not all of it is political, which I kind of enjoyed!

After a couple of segments the host for the day, Pete Hegseth, brought up the new racist claims on a fraternity at the University of California at Irvine. So the story goes that the fraternity, Phi Gamma Delta, recently had a Fiji-themed party at the end of its charity week that has offended certain people. The theme seems reasonable because apparently this particular fraternity has been called “FIJI” since the 1800s. So what’s the problem? Apparently grass skirts and coconut bras are racist in the context of a party. Yep. You can read that again but it is still going to be the same: grass skirts plus coconut bras equal RACISM!

Just hearing about this even being an issue has blown my mind. If anything Phi Gamma Delta is celebrating its nickname and a culture all at once.

I am no stranger to throwing a Hawaiian- or Fiji-themed party from time to time and have never felt like I was doing it in the context of being racist toward a specific group of people. Grass skirts and coconut bras are a certain way for the rest of the world to pay homage to that culture. Let us remember that grass skirts are a part of that culture, coconut bras are not. In fact, Western civilization added the coconut bra because we are too prudish to celebrate our bodies the way that they do. And who doesn’t love the idea of escaping to a paradise where the native people get to walk around in linen clothing by day and celebrate their heritage by night for tourists?

The claim to racism goes beyond grass skirts, coconut bras, UC Irvine, and college campuses. Racism has been a hot topic over the last few weeks. It has been shoved down our throats because of LA Clippers owner Donald Sterling and all of the comments that the sports community has contributed to the issue. Even this week Donald Sterling has been labeled a racist and a sexist by another ex-girlfriend. I’m sick of hearing about it and I am sick of thinking that everything has to be connected with race. Now, on the Donald Sterling front, that is absolutely all about race and the NBA will handle it the best way that it knows how, but to go from Donald Sterling and his extremely racial remarks to a fraternity simply throwing a party with props is ridiculous. Not everything has an ulterior motive. College is a place to celebrate and learn more about other cultures.

We have turned into a culture of political correctness and even the slightest mention of anything about another culture has become some sort of racism. The self-absorbed “everyone is out to get me because I am this” attitude needs to stop! No one is out to get you; no one is bashing your culture just because of grass skirts and coconut bras. We have been celebrating this culture for decades and never has it been an issue until today. It’s sad and it sickens me that we have to walk on eggshells for every little thing. We need stronger backbones again and to realize that not everyone is the same, not everyone is going to agree, not everyone is going to like everyone else. Not everyone is out to get you.

Maybe we should all put on our grass skirts, coconut bras, grab a Mai Tai and chill out!

The most recent American shooting outside Santa Barbara took the lives of seven people, including the shooter, and wounded 13. Allison Dawson reflects on this disturbing trend and the need to place blame at the foot of the shooter alone, and not the gun lobby and NRA.

Hey y’all!

I hope everyone had a great Memorial Day weekend! For me it is always a low-key weekend that usually ends up in quality time with my family, celebrating the holiday honoring the men and women who have died serving in the armed forces protecting our freedom. This weekend also calls for a celebration of my birthday — my actual birthday is today.

Monday was like every other Memorial Day where a small group of my family members get together to have some sort of meal and talk about anything and everything. This time, no surprise, the subject matter of the young man who murdered six people and injured 13 before killing himself near Santa Barbara over the weekend was brought up. A tragedy that is hard to understand but something that has become increasingly normal in our society.

It’s no secret that I have conservative views, as do most of my family members. I was raised with guns around the house, unavoidable when your father is in the military and a gun enthusiast from the South. I was taught early on in life what guns can do, how to handle them but also how to respect them. Shooting a rifle in the backwoods of Mississippi was a summer pastime with my brother under the supervision of our father. I am not a member of the NRA but I certainly support the organization.

As my family and I sat down for lunch, my aunt brought up this news and the press conference where the father of one of the victims, Christopher Martinez, age 20, had made a statement blaming not only politicians but also the NRA for his son’s death.

I cannot imagine the pain that a parent goes through when losing a child to such a heinous act and I understand that with grief comes anger and the need to blame someone for the loss of his child. I have lost friends in the past to guns, either self-inflicted or at the hand of someone else, but never have I once needed to blame anyone except the person who pulled that trigger.

The NRA promotes safety, responsibility, respect, and education toward guns. The NRA did not put that gun into the hands of this obviously disturbed man. Not to mention that in later reports police have discovered that three people were stabbed to death by the same person. Who do we blame then? Victorinox Swiss Army? Spyderco Knives? How about Crate & Barrel for selling cutlery? A knife can be just as deadly as a gun. It is not the method being used but rather the person behind that tool that we should blame.

The scariest part of this whole tragedy is that in some way it could have been avoided. The shooter’s father even contacted police a month ago due to the disturbing YouTube videos his son was posting. Let’s take a step back and think about why the police were unable to do anything about it before all of this occurred. Hindsight is always 20/20 and we can always play the “what if” game, but there were warning signs and nothing was done about them. This is not the fault of the NRA or anyone who supports the Second Amendment. This is the fault of a disturbed young man who felt that he was dealt a bad hand in life and blamed everyone but himself.

With that said, we should all take a minute to pay our respects to those who lost their lives in this tragic event. They are the ones who deserve the attention from the media — not the soulless creature who took them from this earth.
