An Ohio man named Ross Compton, 59, was charged with arson and insurance fraud, based on information police obtained from his pacemaker. While the police had a warrant to look at the data, concerns about medical device privacy are becoming more prevalent, and this Ohio case may just be the beginning.

Compton’s house burned down last year. According to his 911 call when he discovered that his house was on fire, he packed some of his items in suitcases, broke one of his house windows with a cane, threw the suitcases out of the window, and then put them in his car. While investigating the fire, the police obtained a search warrant for the data from Compton’s pacemaker. The pacemaker revealed Compton’s heart rate and cardiac rhythm on the evening of the fire. Experts who analyzed the data came to the conclusion that “…it is highly improbable Mr. Compton would have been able to collect, pack and remove the number of items from the house, exit his bedroom window and carry numerous large and heavy items to the front of his residence during the short period of time he has indicated due to his medical conditions.”

Compton has now been arrested and charged with arson and insurance fraud. The fire caused an estimated $400,000 in damage to the house, and his cat perished. Compton claims that the charges are “utterly insane” and that “this investigation has gone way out of control.”

Concerns over medical device privacy are starting to spring up with a higher frequency, as more of us rely on high-tech devices to help manage our health and wellness. Tools like pacemakers, wearable tech like Apple watches, and the devices that hospitals use–they’re all vulnerable to privacy intrusions. Some concerns are more dire than others, for example, the hacking of medical devices, could hold individuals or entire hospitals hostage.

Generally, the use of medical devices by the police is relatively new. But it’s started to gain traction. Fitbits and other fitness trackers–though perhaps not technically medical devices–have already been used as evidence in court. In a Lancaster, Pennsylvania, case, attorneys used a Fitbit to prove that a woman had lied about being sexually assaulted, as the data from the tracker showed she was up and walking during the time that she alleged she was assaulted. Compton’s pacemaker evidence, while certainly a step further, seems like a likely path. But that doesn’t mean that there won’t be a fight over the use of this kind of data every step of the way. SC Magazine spoke to Electronic Frontier Foundation Criminal Defense Staff Attorney Stephanie Lacambra, who said:

Americans shouldn’t have to make a choice between health and privacy. We as a society value our rights to maintain privacy over personal and medical information, and compelling citizens to turn over protected health data to law enforcement erodes those rights.

EPA Critic to Head the EPA

This morning, Trump’s transition team announced that the new head of the Environmental Protection Agency will be a firm critic of the agency, climate change denier Scott Pruitt. Pruitt is Oklahoma’s Attorney General, and has close ties to the fossil fuel industry. He has fought President Obama’s climate efforts and has sued the agency he will now be leading, first over the reduction of greenhouse gas emissions from the electricity sector and then over regulations of methane emissions from the oil and gas sectors.

Many believe that this appointment will be disastrous for the environment. “Our country needs–and deserves–an EPA administrator who is guided by science, who respects America’s environmental laws, and who values protecting the health and safety of all Americans ahead of the lobbying agenda of special interests,” said Fred Krupp, president of the Environmental Defense Fund.

Sunday night a fire broke out at the Florida mosque that Orlando shooter Omar Mateen used to attend. The St. Lucie County Sheriff’s Office said it got a 911 call around 12:30 am Monday and fire crews were sent to extinguish the fire at the Islamic Center of Fort Pierce. According to the authorities, security footage obtained from the mosque indicated it might be arson. In a statement they said:

Video captured at the Fort Pierce Islamic Center shows an individual approached the east side of the building just moments before a flash is seen and the fire starts […] As soon as we are able, we will release the video of this incident and ask for the public to assist us in identifying the person or persons responsible.

The timing of the fire is particularly troublesome as it comes right after 9/11 and the morning before the big Muslim holiday Eid-al-Adha, the holiday of the sacrifice. It’s a major Muslim holiday that is celebrated by prayer, visits to family and friends, exchange of gifts, and feasts. It goes on for four days and commemorates when God appeared to Ibraham and asked him to sacrifice his son. As Ibraham was ready to do so, God stopped him and rewarded him for his loyalty.

David Thompson from the Sheriff’s Office spoke to reporters early Monday morning, saying:

I don’t want to speculate on a motive. We all know the implications of the date and the time of year that this is — the 9/11 anniversary. Is that related? I wouldn’t want to speculate, but certainly that is in the back of our minds.

Omar Mateen, who was responsible for the mass shooting at the gay nightclub Pulse in June, occasionally visited the Islamic Center to pray with his family. People there described him as quiet and focused on his prayers. If this connection is the reason that someone put the mosque on fire remains to be seen. It is also unclear how badly damaged the mosque was. People that wish to pray and honor Eid-al-Adha were asked to go to other mosques nearby.
