Hey y’all!

Two of my favorite things in the whole wide world have collided! The Real Housewives franchise on Bravo TV and the law! Real Housewife of New Jersey Teresa Giudice and her hubby Giuseppe “Joe” Giudice were charged with 41 counts of conspiracy to commit mail and wire fraud, bank fraud, making false statements on loan applications and bankruptcy fraud back in 2013 and yesterday they were both sentenced.

First, “Juicy” Joe.

He received 41 months in a federal prison, has to pay $414,588.90 in restitution, plus a $10,000 fine, and has to complete an alcohol treatment program. It’s great that he has to do the alcohol program, but I think it is a little bit too late for that idea. Back in 2010, good ol’ Joe flipped his truck in a DWI crash but never really got punished for it. After losing his license in that crash, he posed as his brother to get a new driver’s license, and it’s that crime for which he might be deported to Italy — the country of which he is a citizen — after getting out of prison.

Teresa got 15 months in jail; prosecutors argued against house arrest because it would be a little fucked up for her to chill out in the house she basically defrauded others in order to build. The upside is the judge is allowing Teresa and Joe to go at separate times so that their four daughters do not suffer too much. Teresa will serve first and I imagine she probably won’t stay in for the whole 15 months. Think Paris Hilton, Lindsay Lohan, or Nicole Richie jail time. Which makes me wonder if jails are sexist because these women were in jail for short periods of time but DMX and O.J. Simpson were not let out early (but we all know why O.J. is really in jail).

Naturally, Joe and Teresa will sit down and do their first interview after the sentencing with Andy Cohen of Bravo TV. Andy is the glue that holds all of the hot mess shows together on that network and he does a great job!

I am a huge fan of all things Real Housewives. You can get on that hot mess express and ride it around for an hour, hop off and go about your life until that next episode comes on. Originally when I started watching RHONJ I was not too fond of Teresa until she flipped that table.

Joe didn’t seem to be around much at first, but that was okay because there was enough drama to fill more hours than viewers could stand. Slowly but surely over the past few seasons Joe has stepped up his game in showing his face. I HATED Joe a season or two back when he basically made it seem like a phone call he received was from a mistress and then proceeded to call his wife a bitch. Tool bag!

But this season, if you’ve been watching, you get to see a better side of Joe and he has somehow turned into a decent guy. I can tell you one thing, even though I may have never been fond of him or how he treated Teresa he has always seemed to be a good dad!

Teresa and Joe have four little girls; Gia, Milania, Gabriella, and Audriana. Milania stole the show the moment that camera turned to her. She is one opinionated, mouthy kid but you gotta love her!

What blows my mind about this whole situation is that there were 41 counts and all of this spanned a four-year time period. It is great to know that prosecutors were able to catch them and make them pay for their choices but I wonder how much of that is because they decided to join the Real Housewives of New Jersey. If the spotlight had not been on them would they have perhaps gotten away with it or even gone on to commit more fraud?

Our judicial system works, but does it work better when celebrities are involved?

The strange, long, and twisted tale that was the death of Reeva Steenkamp, girlfriend of Olympic athlete Oscar Pistorius, has started to reach its close. Pistorius was found guilty of culpable homicide in the Steenkamp case.

Oscar Pistorius is a South American athlete who made history by being the first double amputee in the Olympic Games, and has an incredibly impressive Paralympics resume.

But on the morning of February 14, 2013, that all changed. Pistorius shot and killed his girlfriend Reeva Steenkamp through the locked bathroom door. She was a South African model, and the pair had been dating for three months. Pistorius admitted from the beginning that he had shot her, but claimed that he had thought that she was an intruder.

The facts that came out during the subsequent trial were dark. In addition to the being put on trial for killing Steenkamp, Pistorius also faced two charges for illegal handling of his firearms, and a fourth charge for illegal possession of some of the ammunition that was found in his home after Steenkamp was killed.

During the trial, a break was taken so that Pistorius could be evaluated by doctors and receive a psychiatric evaluation. He has been diagnosed with generalized anxiety disorder, which was used by the defense to explain his concern about an intruder in his home on the morning of February 14. Merryll Vorster, a forensic psychiatrist who testified during the trial, explained that Pistorious’ anxiety disorder was most likely why he always slept with a firearm under his pillow. Vorster also explained that Pistorius did not have his prosthetics on when he shot at the door, indicating that a fight mechanism may have been ignited in Pistorious — he literally could not flee.

Judge Thokozile Matilda Masipa stated on Thursday that Pistorius was not going to be found guilty of murder, but left the other charges for Friday.

The culpable homicide verdict, announced Friday, translated into American justice system terms, essentially means that he was found guilty of involuntary manslaughter. He acted negligently when he shot four shots through his closed door without knowing who or what was on the other side. He won’t actually be sentenced until next month, and what his sentence will actually end up being has a huge range. He could serve up to fifteen years in prison, or a sentence that is significantly shorter. Judge Masipa has received significant criticism for her ruling.

Given that no one will really ever know what happened in Pistorius’ house that fated Valentine’s Day morning, the verdict is understandable. Yet there is still a lot of backlash from those who believe it’s not quite enough. And Pistorious’ actions after receiving the verdict don’t do too much to help him. He has said that he’s going to write a book to tell his side of the story, and the South African Olympic Committee has said he is free to run again once he finishes his sentence.

However, the good thing about these much-watched celebrity trials is that occasionally they are high-profile enough to create a national conversation. As Steenkamp’s father put it:

This case in a very strange way has opened a window into people’s lives in South Africa, the way they feel they need to defend themselves with extreme force. People need to think about this.

The story was disturbing, the trial concerning, and the death of Steenkamp incredibly tragic. Yet trials like this do have the opportunity to say something for a nation; hopefully South Africa is listening.

Not even the rich and famous can escape being subpoenaed. And sometimes, a delusional fan is the reason for it.

At the premiere of his latest movie last Thursday, Johnny Depp was served legal documents calling him as a witness in a murder case. But Depp wasn’t a witness to the crime, nor does he know the person who committed it. So what’s the connection?

In 2009, Nancy Lekon  was driving in Los Angeles when she struck and killed a passenger, who was dragged by her car for over a mile. Lekon claimed that she was in such a rush because she was on her way to meet Depp; with whom she claimed to be in a relationship.  But there is no connection between Depp and Lekon besides the woman’s (perhaps) delusional obsession with him.

Lekon’s lawyer has been trying to prove she is not guilty by reason of mental insanity, and wants Depp’s testimony to prove that. If Depp testifies that he was not dating Lekon, it would go to support the claim. The fact Depp was subpoenaed is a bit of an anomaly in itself. A subpoena is a legal document that compels someone to testify in court. If you’re subpoenaed and don’t show up, you could be held in contempt.

In a lot of cases, it makes sense to subpoena someone. If there is a crime with one key witness, or someone with a very specialized field of knowledge, it would make sense to compel them to testify in a trial- without them, important information would not be heard by the jury or judge, and the verdict could be skewed as a result. But in this case, it seems like just about anyone could have surmised that Lekon wasn’t actually dating Depp.

So why was Depp subpoenaed so publicly, five years after the crime? One would assume Mr. Depp’s publicists could have gotten this information to Lekon’s attorney in writing, and have the information be just as effective. It’s possible that despite this subpoena, which Depp probably wasn’t expecting, he won’t take the stand physically. Rather, he could submit a written statement, or testify via a phone call.

This isn’t the first time a celebrity will have testified about someone they don’t know. In November of 2013, Alec Baldwin took the stand to testify against a stalker of his. But the difference between Baldwin and Depp is that Baldwin’s life had been affected by the woman stalking him- as she repeatedly called and messaged him. Depp, on the other hand, has never been in contact with Lekon.

Nonetheless, the tactic is an interesting one from Lekon’s public defender. There will probably be other medical evidence and professional testimony to support the insanity defense, but the ability to utilize a figure as public and well known as Depp himself might really drive home the attorney’s assertion about Lekon. While many people claim insanity defense as a way to escape being held responsible for their actions, a delusion as grandiose as this one could be the icing on the cake to help Lekon escape this murder charge.

And while this is definitely a new (and odd) tactic, it’s possible that Lekon’s attorney is doing it for show. In situations like this, where a party has relevant information but could provide the same information in a written format, they would just go through a deposition. So the fact Depp was served these papers at his movie premiere, about a 5-year-old case, regarding a woman he has never met, seems fishy at best. Knowing the extent of Depp’s resources, it wouldn’t be surprising if his own lawyers find a way for Depp to get out of testifying in person.
